COURTHOUSE,
Feb 13 –A man from Mexico who
entered the US in 2024 through
the CBP One app was detained
by ICE in 26 Federal Plaza on
February 13.
Later that day he
filed a habeas corpus petition
in the US District Court for
the Southern District of New
York, where Inner City Press
found it.Â
 The
petition says that while he
was arrested by NYPD in
September 2025, the Queens
DA’s office pursuant to Brady
told his lawyer the
complainant had recanted: “she
recanted her statement and is
uncooperative to move forward
with the trial. We will move
to dismiss.”
 Judge
Andrew L. Carter, as Part 1
judge, stayed any removal
without approval of the court.
