NLRB Orders Amazon to Bargain with Teamsters-Affiliated Staten Island Union - News and Statistics

The National Labor Relations Board has directed Amazon to recognize and negotiate with a union at a New York City warehouse, according to a report from FreightWaves. The board found that the company unlawfully refused to bargain with the union, which was originally an independent entity known as the Amazon Labor Union after its election in April 2022 but has since affiliated with the Teamsters.

Amazon has consistently contested the validity of the union’s certification as the exclusive bargaining representative for the facility, known as JFK8. The NLRB‘s regional director for New York certified the union in January 2023, after which the union filed a charge alleging Amazon’s refusal to bargain. The company confirmed it was testing the certification and intended to challenge it. The union had initially requested bargaining on April 2, 2022, but the company has not engaged in negotiations since that time.

The current NLRB order requires Amazon to cease its refusal to recognize the union and to begin bargaining. The board’s decision was issued by a panel that recently regained a quorum and voted 2-1 in favor of the union despite a Republican majority.

In response, Amazon stated that the original election certification was flawed due to improper influence and that the NLRB ruling is part of its process to challenge that certification. The company expressed confidence that a court would overturn the result. The Teamsters had not commented on the decision at the time of the report’s publication.

The NLRB’s action followed an unrelated agreement between Amazon and the Teamsters concerning financial penalties for workers walking off the job during unionization efforts. Beyond the Staten Island location, the only other Amazon employees to have voted for unionization are at a Philadelphia Whole Foods. A previous unionization attempt at an Alabama facility was unsuccessful.

Separately, some workers at delivery service partners associated with Amazon have pursued unionization through card check methods, with only one such partner recognizing a union before later ending its relationship with Amazon, a matter now before the NLRB. Throughout various unionization efforts, Amazon has highlighted its compensation and benefits packages.
