State Sen. Jeremy Cooney on Friday unveiled a new piece of legislation, calling on New York state to be liable to fix cars damaged by potholes year-round.
State law currently states drivers can only pursue damages from the state on a state road between May 1 and Nov. 15.
Meanwhile, if your car hits a pothole on a non-state road and is damaged, drivers can call the municipality where that pothole is and pursue damages at any point throughout any given year.
“Basically, you can hit a pothole in the month of April and be out of luck,” Cooney said. “But in two weeks, hit a pothole in May, [and] get the state to reimburse you for the amount of damage to your vehicle. We want to change that.”
Cooney also wants the State Department of Transportation to create a new online tool letting residents report pothole locations.
