5/21; 4:48 p.m.—Demonstoy remained on a ventilator and was legally pronounced dead at 3:18 p.m. on May 18.

An autopsy was scheduled for May 21 through the Onondaga County Medical Examiner’s Office.

Investigators believe Demonstoy’s injuries happened during a fight with another incarcerated individual.

New York State Police are assisting the Office of the Attorney General with the investigation.

“The Attorney General’s Office has jurisdiction in matters involving the death of a person while in custody or in cases where there is a question as to whether the death was caused by the act or omission of a police officer or peace officer,” according to State Police.

UTICA, N.Y. — A Marcy Correctional inmate is in the ICU at Wynn Hospital with life-threatening injuries.

New York State Police said 45-year-old Terry Demonstoy was found unconscious in a bathroom after a fight with another inmate on Friday.

Demonstoy is serving two to four years in prison on grand larceny charges.

His earliest release date is in two weeks.
