On June 3rd, 2026, Joseph Penzella, 41, of Bronx, NY, was arrested and charged with possession of forged instrument 1st degree, conspiracy 4th degree and grand larceny 4th degree, following an investigation into 22 forged $100 bills that were allegedly used at a local department store on Veteran’s Memorial Drive.

Penzella, along with an outstanding accomplice, allegedly passed the forged US currency at the local store to purchase merchandise in excess of $2000.00.

Penzella was arrested on similar charges in Monroe County and turned over to the Genesee County Sheriff’s Office upon his release, he was held for CAP Court arraignment.

Tyshon H. Hawkins, 33, of Brick, NJ, is charged with reckless endangerment 1st degree, grand larceny 4th degree, possession of burglar tools, endangering the welfare of a child, unlawful fleeing from a police officer in a motor vehicle 3rd degree, leaving the scene of a person injury accident and reckless driving, after a larceny incident at 4180 Veteran’s Memorial Drive on May 17th, 2026.

Hawkins allegedly usde a metal tag remover and confiscated several high value items from Dick’s Sporting Goods, passing all points of sale without purchasing the items.

Deputies attempted to seize the merchandise from Hawkins, but he fled in a motor vehicle and during the pursuit, Hawkins struck another vehicle and continued on. Hawkins was apprehended and held at the Genesee County Jail pending a CAP Court appearance on May 18th.

Craig D. Brown, 45, of Batavia, NY, is charged with assault 2nd degree, after allegedly assaulting another person while he was incarcerated at the Genesee County Jail on May 23, 2026 .

Brown was scheduled to appear in CAP Court on May 24th, 2026, at 9:30a.m.

Abigail M. Barclay, 21, of Batavia, NY, is charged with assault 3rd degree and endangering the welfare of child after allegedly striking another person in the face on Gaslight Lane on June 7th, 2026, causing physical injury while in the presence of a child on June 7th, 2026.

On May 29th, 2026, Kirby R. T. Heath, 22, of Lackawanna, NY, was arrested following a traffic stop on Sumner Road in the Town of Darien. Heath was arrested and charged with DWI, operating a motor vehicle with a BAC of .08% or more alcohol, operator leaving the scene of a property damage accident, and open container of alcohol in a motor vehicle.

Heath was transported to the Genesee County Jail for processing and was issued uniform traffic tickets for all charges and released. Heath is to appear in Darien Town Court on June 23, 2026 at 4:00p.m.

Sandra L. Marsceill, 54, of Batavia, NY, is charged with offering a false instrument for filing 1st degree and criminal use of benefit card 2nd degree, after allegedly using another person’s DSS benefits on February 12, 2026.

Marsceill will appear in Batavia Town Court on June 23, 2026 at 1:00p.m.

On May 30th, 2026, deputies responded to a larceny in progress call at Dick’s Sporting Goods, 4180 Veteran’s Memorial Drive in the Town of Batavia. Deputies say two females were reportedly in the dressing room of the store, removing sensors from merchandise.

Upon arrival, deputies made contact with two females along with two children in the dressing rooms.

The individuals were identified as Diamond S. Stewart and Christina M. Trotter, no ages or addresses provided. Both were placed under arrest and transported to the Genesee County Jail for processing.

They are each charged with grand larceny 4th degree, conspiracy 6th degree, endangering the welfare of a child, tampering with physical evidence and possession of burglar tools. They were released on appearance tickets and will be arraigned in the matter on June 23rd, 2026, in Batavia Town Court at 10:00a.m,

On May 30th, 2026, Shanita T. Jackson, 30, of Saugerties, NY, is charged with grand larceny 4th degree and conspiracy 5th degree. Jackson, working alongside an accomplice, confiscated items from BJ’s Wholesale Club and passed all points of sale without paying .

Jackson was being held at the Genesee County Jail and is scheduled to appear in CAP Court on May 31, 2026 at 9:30a.m.

Clifford S. Gamboa, 30, of Saugerties, NY, is charged with grand larceny 4th degree, conspiracy 5th degree and burglary 3rd degree, after allegedly confiscating items from BJ’s wholesale at 8330 Lewiston Road in Batavia on May 30th, 2026. Gamboa was previously trespassed from BJ Wholesale Club and was not lawfully allowed inside the store.

Gamboa was being held at the Genesee County Jail and was scheduled to appear in CAP Court on May 31st, 2026, at 9:30a.m.

Scott Lazarony, 43, of Batavia, NY, is charged with criminal possession of firearm and tampering with physical evidence, after allegedly being in possession of an illegal handgun and then discarding it during the course of an official police investigation on February 12, 2026.

Lazarony was taken into custody at the Genesee County Jail and processed before being released on an appearance ticket.

Lazarony will appear in the Town of Batavia Court on July 14, 2025 at 10:00 a.m.

Jon H. Bush, 66, of Batavia, NY, is charged with criminal possession of a controlled substance 7th degree after allegedly possessing an unlawful controlled substance on June 1, 2026. Bush was transported to the Genesee County Jail for processing and was released on an appearance ticket, He will appear in Batavia Town Court on June 23rd, 2026 at 10:00a.m.

On June 7th, Nicholas E. Patterson, 32, homeless, is charged with criminal mischief 4th degree after allegedly damaging property that did not belong to him.

Patterson was transported to the Genesee County Jail where he was held, pending a CAP Court arraignment on June 7th, 2026, at 7:00p.m.
