The suspect in the shooting of two men, one fatally, in a southwest Reading apartment was taken into custody over the weekend in New York, Berks County District Attorney John T. Adams said Monday.
Berks authorities were waiting to hear from officials in Orange County whether the suspect, Amaury Rosado‑Laboy, 43, planned to fight extradition to Pennsylvania to face the charges, Adams said.
Reading police charged Rosado‑Laboy, who has no permanent address, with first‑, second‑ and third‑degree murder; aggravated assault; burglary; and a weapons offense after one of the victims identified him as the shooter early Friday morning in the 500 block of Lancaster Avenue.
He was taken into custody over the weekend on a warrant from Reading police. Orange County, north of New York City, is considered part of the Hudson Valley region of the state. Details of his arrest were unavailable.
He is accused of breaking into the apartment above a storefront about 2 a.m. and shooting his brother, Alex B. Rosado‑Laboy, 45, who died at the scene, and another man, who suffered a gunshot wound to the jaw. Both victims lived in the apartment.
An autopsy was scheduled Monday in Reading Hospital to determine the cause and manner of death for Alex Rosado‑Laboy, Berks County Coroner Matthew J. Stitzel said.
According to the probable cause affidavit:
Police arrived at the apartment for a 911 call about a shooting and encountered a man, listed in court documents as Victim #2, bleeding profusely from a gunshot wound to the jaw. Officers then found Alex Rosado‑Laboy dead on the kitchen floor.
City paramedics transported Victim #2 to Reading Hospital for further treatment.
A female resident told police that she was asleep in the rear bedroom when she was startled awake by the sound and flash of a gunshot. She saw a shadowy male figure running away.
Victim #2 came into the bedroom holding his face. He told her that Amaury Rosado‑Laboy had just shot him and Alex Rosado‑Laboy.
The woman jumped out of bed and saw Alex Rosado‑Laboy unresponsive on the floor. She called 911.
Police secured the apartment and surrounding area as a crime scene. Investigators noticed a window screen in the middle room appeared to have been forced in and bent. They also noticed the door to the bedroom of Victim #2 appeared to have been forced open, with wood surrounding the deadbolt cracked.
Footage from a nearby residential security camera shows a male exiting the front door of the apartment after the shooting and running west on Lancaster Avenue. He is seen wearing a backpack.
Additional footage shows the same man walking west in the north alley behind the 600 block of Lancaster Avenue about 2:05 a.m., approximately three minutes before police were dispatched for the shooting call.
