Homeowners challenging New York City’s methods for implementing its new pied-à-terre tax haven’t suffered a sufficient injury to bring the lawsuit, the city told a state trial court.
“None of the individual Petitioners argue that they have been wrongfully subjected to the surcharge,” and can’t seek a judgment that would bind individuals not before the court, the city’s corporation counsel told the New York Supreme Court for Richmond County in a Tuesday brief opposing the homeowners’ complaint.
