The lawsuit was filed in Bergen County Superior Court on Wednesday, Sept. 23, by a minor identified as A.L., through guardian Katherine Garcia, against the Cliffside Park Board of Education, also known as the Cliffside Park School District. 

The child was participating in activities with another student at Public School #6 on May 20, 2025, when the other student physically assaulted the child, according to the complaint. 

The district failed to provide adequate supervision and safety measures to protect the child from foreseeable harm, the suit says.

The child fell and suffered fractures to the right distal radius and ulna, bones in the forearm, requiring medical treatment, the complaint says. 

The lawsuit accuses the district of failing to properly supervise both students, monitor student interactions, provide a reasonably safe environment, and implement or enforce appropriate safety procedures.

Garcia and the child are seeking damages for the injuries and losses, along with interest and legal costs. They have also requested a jury trial.
