STATEN ISLAND, N.Y. — A defendant who was carried into an NYPD stationhouse after a recent arrest on Staten Island is requesting his bail be lowered.
Daquan Sidbury, 34, of Van Pelt Avenue in Mariners Harbor, is charged with criminal possession of a loaded firearm, possession of cocaine and intent to damage property in connection with an Aug. 21 incident on the borough’s North Shore. His bail was set at $300,000 bond or $150,000 cash.
Court proceedings revealed this week that Sidbury filed a motion with Justice Alexander B. Jeong in state Supreme Court, St. George, requesting a new bail amount.
During a scheduled appearance on Thursday, defense attorney Michael Cirigliano argued that while his client has had prior run-ins with law enforcement, he has almost always shown up for court, with the exception of one warrant on a DWI charge, for which he voluntarily returned to court.
Cirigliano asked that bail be reduced to a $25,000 bond, which would require a 10% payment that his client’s family might be able to afford.
Conversely, prosecutors cited Sidbury’s prior convictions and several arrests.
After hearing from both sides Thursday, Jeong ordered that bail remain as is, noting the defendant’s criminal history and the DWI warrant. He adjourned the case to Dec. 18.
The defendant has pleaded not guilty to the charges.
Resisting arrest, police allege
Authorities said the incident first unfolded at about 6:30 p.m. near Castleton and Bement avenues in West Brighton.
Sidbury removed a loaded, black-and-green Ruger LCP from his jacket pocket, a criminal complaint alleged.
Police arrested him later near Bay Street and Slosson Terrace in St. George, where he was found standing near a loaded handgun, according to court documents.
When officers tried to handcuff Sidbury, he allegedly stiffened his arms and legs and lay down on the ground. Officers were forced to carry him into an NYPD vehicle and then into the 120th Precinct stationhouse in St. George, according to the complaint. Once inside the building, he allegedly slammed his head into a picture frame and cracked the glass.
A short time later, according to court documents, officers seized multiple plastic bags of cocaine from the defendant.
‘I got something for you’
In May, Sidbury allegedly menaced a person in Mariners Harbor, in the vicinity of Van Pelt and Forest avenues, court records show.
That criminal complaint alleged the defendant pointed what appeared to be a black firearm at the victim and said, “I got something for you.”
Sidbury was arrested on May 28 on charges of misdemeanor menacing.
