The Second Circuit shut down efforts to revive a lawsuit challenging a New York City law requiring landlords who participate in Section 8 housing to allow searches of their premises.
The court affirmed dismissal of the case on the grounds that it doesn’t have jurisdiction over the claims, but didn’t address the merits of the case. The plaintiff—the trust that owns a 48-unit residential apartment building in Manhattan—can pursue its claims in state court once it has gone through the administrative review and hearing process with the city, the Second Circuit said in its unsigned order.
