Soon, millions of New Yorkers will see an increase in their paycheck. As part of a bill passed back in 2023, the final increase to minimum wage in New York State will take place on January 1st, 2026.

Minimum Wage Increase Coming To New York State

Starting on January 1st, 2026, the third and final increase to minimum wage will take place in New York State. The state’s minimum wage will increase to $17 per hour for workers in Downstate New York, while the minimum wage for workers in the rest of the state will increase to $16 per hour.

The minimum wage for servers and tip-based jobs will increase from $11 per hour to $11.35 per hour for Downstate workers, and for servers elsewhere in the state will increase from $10.35 to $10.70 per hour.

After this third and final wage increase, the minimum wage in New York State will be tied to the regional Consumer Price Index rate in New York State.

Meal Credit Adjustments For Workers In New York State

New York State also allows employers to provide meals or meal credit to employees, which can be included in their wages. Under the New York Hospitality Industry Wage Order issued by the New York Department of Labor, the meals must meet strict requirements to qualify for the wage credit.

These guidelines state that meals must include at least one type of food from four categories: “(1) fruits or vegetables; (2) grains or potatoes; (3) eggs, meat, fish, poultry, dairy, or legumes; and (4) tea, coffee, milk, or juice.”
