Liability for Brooklyn Pedestrian Accidents

Speeding remains a major cause of car accidents in New York and the United States. According to the National Safety Council, “Speeding was a factor in 29% of all traffic fatalities in 2023, killing 11,775, or an average of over 32 people on a typical day. The total number of fatal motor-vehicle crashes attributable to speeding was 10,541.” Many factors aside from speeding could contribute to a pedestrian collision.

Distracted driving
Inclement weather
Poor road conditions
Driver fatigue

All drivers must operate their vehicle with the care necessary to avoid collisions. To that end, they must continuously scan the road ahead of them and slow down when necessary to avoid colliding with any pedestrian on the roadway. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. Certain steps should be taken after any pedestrian accident.

The police should be called to the scene as soon as possible so that they can investigate.
Photos of the accident site should be taken.
Eyewitnesses should be interviewed.
Victims should seek experienced legal counsel.

It can be hard to know what to do after any car accident. Victims are often left with serious injuries and may need to take extensive periods of time away from work. They may also be burdened with high medical bills. Any person injured in a pedestrian accident may be able to seek some measure of justice through a personal injury claim. This extends to the family of any pedestrian who is killed due to the negligence of another driver.
