MARCY, N.Y. — A former Marcy Correctional officer who was cleared in the death of inmate Robert Brooks is suing New York State for $5 million.
Nicholas Kieffer filed his claim on Jan. 20.
Kieffer said that the State owes him back pay and damages after a jury acquitted him of all charges in Brooks’s death.
The claim accuses the State of malicious prosecution, defamation and breach of contract.
Kieffer and Mathew Galliher were acquitted at trial in October.
