Gov. Kathy Hochul announced Tuesday that the state is suing the Trump administration, accusing it of illegally withholding billions of dollars in federal funding for the Second Avenue Subway extension.

“We’re suing the Trump administration for illegally withholding billions of dollars for the Second Avenue Subway extension. For months, they’ve stood in the way of progress. New Yorkers can’t afford to wait,” Hochul wrote on X.

According to the suit, the MTA is seeking the release of funds for the planned expansion into East Harlem. The legal action follows a warning from the agency last month, when it threatened to sue over nearly $60 million in unpaid federal reimbursements tied to the project.

Transit officials say they have not received any of the promised funding since October.

In a statement, Hochul said construction is already “underway” and remains on track, but warned the funding pause could jeopardize progress.

“The project is moving on schedule and on budget. But Donald Trump’s unlawful funding pause has put this entire project at risk,” she said.

NY1 has reached out to the U.S. Department of Transportation for comment and has not yet received a response.

The dispute marks the latest clash between New York and the Trump administration over infrastructure funding.

Last month, a court ordered the administration to restore funding for the Gateway Tunnel Project after a lawsuit from New York and New Jersey.

The Second Avenue Subway extension, which would bring service to 125th Street, is estimated to cost about $7 billion, with roughly $3.4 billion expected to come from the federal government.
