A 30-year-old man was shot in the head at around 9:15 p.m. and was taken to the hospital via private means, police said. Sources said the victim has been declared brain dead, but still alive as of Wednesday.

The detective from the Gracie Mansion security detail has not been charged, sources said.

The NYPD officer is accused of opening fire and hitting a person inside a car during an altercation that was caught on surveillance video.

According to PIX11 News sources, the off-duty detective was following a car with people he suspected of stealing his vehicle.

The two vehicles then pulled over in front of an apartment building. When one person got out, a confrontation followed. A gun was raised, and sources said one of the bullets struck a passenger inside the car in the head.

Another bullet went through the window of a nearby restaurant, narrowly missing patrons and a bartender inside.

Video appears to show the detective detaining a person on the ground as the suspected car thieves drive off, rushing the gunshot victim to a Manhattan hospital. Sources said the cop identified himself at the scene after police responded to the shooting.

If the victim dies, the investigation will be referred to the New York Attorney General’s Office.

The NYPD’s Force Investigation Division is handling the case.
