Rivera, 36, was acquitted of first-degree murder at his trial earlier this month, but was found guilty on the four other charges
“This defendant ignored repeated lawful commands and used an illegal firearm to kill a dedicated police officer and attempt to murder an NYPD sergeant,” Queens District Attorney Melinda Katz said in a statement.
“Jonathan Diller represented the very best of law enforcement: courage, commitment and service to community. He was a father, a husband and a son,” she added. “The void left by his senseless loss at the hands of this defendant is immeasurable.”
Rivera, 36, was acquitted of first-degree murder at his trial earlier this month, but was found guilty on the four other charges.
He faced a maximum sentence of life in prison.
In March of 2024, Rivera shot and killed Diller in Far Rockaway. Prosecutors said Diller was on patrol when he and fellow officers spotted Rivera with what looked like a gun in the front pocket of his sweatshirt.
During a struggle, prosecutors said Rivera intentionally aimed the gun under Diller’s bulletproof vest and fatally shot him.
Rivera’s defense argued the shooting was accidental, claiming the gun discharged during a struggle with another officer.
The NYPD posthumously promoted Diller to the rank of detective.
