New York State Police are investigating what they say was a fatal assault at Marcy Correctional Facility.
Troopers responded to the state prison on May 16 in response to an assault involving an incarcerated individual identified as Terry Demonstoy, 45, who sustained serious injuries and was discovered around 11:55 p.m. May 15 by a correction officer, police said.
Officers located Demonstoy unconscious in a bathroom with significant injuries, and he was taken to Wynn Hospital and treated in the intensive care unit. Demonstoy remained on a ventilator and was pronounced deceased at 3:18 p.m. Monday, State Police said. An autopsy was scheduled by the Onondaga County Medical Examiner’s Office for Thursday.
“At this time, investigators believe Demonstoy’s injuries were sustained during an altercation with another incarcerated individual,” State Police said.
The state attorney general’s office is assisting with the investigation pursuant to state law.
Marcy Correctional Facility is where several correctional officers beat Robert Brooks, a 43-year-old incarcerated individual who died from compression of the neck and internal injuries on Dec. 10, 2024, nearly seven hours after he arrived at Marcy. His death was ruled a homicide.
The last of several former Marcy Correctional Facility officers charged in the case was sentenced in January.
Last month, the New York State Correctional Officers and Police Benevolent Association (NYSCOPBA) told Gov. Kathy Hochul that the state Department of Corrections and Community Supervision (DOCCS) was in a full-scale “systemic emergency” following a surge in violence, contraband, staff assaults and deaths inside prisons, among other issues.
In March, a drone dropped a package filled with knives and other contraband inside a secure area of the Marcy Correctional Facility, DOCCS said.
