“In December 2024, New York joined its neighbor to the east, Connecticut, in allowing all workers to file for workers’ compensation for specific types of mental injuries or extraordinary work related stress (S6635/A5745). In response, employers, attorneys and the courts braced themselves for an expected influx of new mental health-related claims. 18 months later, however, we have seen little legislation in the space. Yet the lack of cases does not show the complete picture. There is reason to believe that the law has already spurred positive change, with employers expanding mental health benefits for their workers.”
