New York City resident Yordi Silverio Marte Brito, 27, was arrested on Sunday, June 28, following a welfare check in Lewisboro, New York State Police announced on July 3.

According to the agency, the incident happened around 4:35 a.m, when troopers conducted a welfare check on a Jeep stopped on the shoulder of Interstate 684 in Lewisboro. 

Troopers said the driver, identified as Marte Brito, showed signs of intoxication during the investigation. After administering standardized field sobriety tests, investigators said they found a 1-year-old child was also inside the vehicle. 

Marte was taken to the State Police barracks in Somers, where he submitted to a chemical breath test that measured his blood alcohol content at 0.08 percent, according to police.  

Marte Brito was charged with aggravated DWI with a child passenger under Leandra’s Law, DWI with a blood alcohol content of 0.08 percent or more, and standard DWI. 

He was issued appearance tickets directing him to appear in Lewisboro Town Court on July 20 at 5 p.m. 

Meanwhile, child was safely released to a sober third party.
