A New York City employee can proceed with claims the city failed to accommodate his respiratory illness-related disability by denying his work-from-home requests, a federal appeals court ruled.
The US Court of Appeals for the Second Circuit found the district court erred in dismissing Emil Cangro’s claims the city failed to provide him reasonable accommodations for his disability when he asked to work from a separate office or from home during the Covid-19 pandemic, Judge Amalya Kearse, a Carter appointee, wrote in a unanimous Friday opinion.
