On August 2, 2026, at approximately 3:20 a.m., New York State Police in Somers observed a vehicle traveling southbound on Interstate 684 in the Town of North Salem in violation of the New York State Vehicle and Traffic Law.
During the traffic stop, the operator, identified as Jonathan Danilo Burgos Pua, 33, of Bronx, New York, exhibited signs of intoxication. Standardized Field Sobriety Tests were administered, and further investigation revealed that an 11-year-old child was in the vehicle at the time of the incident.
Burgos Pua was taken into custody and transported to State Police Somers for processing, where he submitted to a chemical breath test that yielded a blood alcohol content (BAC) of 0.09%. The child was safely released to a sober third party.
As a result of the investigation, Burgos Pua was charged with:
Aggravated Driving While Intoxicated with a Child Passenger (Leandra’s Law), a Class E felony;Driving While Intoxicated with a Blood Alcohol Content of 0.08% or More, an unclassified misdemeanor; andDriving While Intoxicated, an unclassified misdemeanor.
Burgos Pua was issued traffic tickets returnable to North Salem Town Court on August 24, 2026, at 5:30 p.m.
