DOJ sues Vermont, New York over in-state college tuition for noncitizens

  • August 10, 2026

MONTPELIER, Vt. (WCAX) – The Department of Justice has filed a lawsuit against Vermont, New York and Connecticut over policies that allow noncitizen residents to receive in-state tuition.

Vermont’s law, passed in 2022, allows refugees to pay the in-state tuition rate at all schools in the Vermont State College System.

The Department of Justice says the law discriminates against U.S. citizens.

WCAX News reached out to the University of Vermont and Vermont State University for a response to the lawsuit but had not yet heard back when this story was published.
