A person was shot by ICE agents Thursday afternoon in an Upper Manhattan neighborhood in New York, according to three law enforcement sources familiar with the case.

The shooting occurred during an Immigration and Customs Enforcement (ICE) operation on Marble Hill Avenue around 4 p.m., the sources said.

One source indicated that the person shot was apparently inside a vehicle when at least one agent opened fire. The person is expected to survive.

An extensive police investigation has focused on a black sedan believed to be the vehicle involved in the shooting. A senior official indicated that a 5-year-old child was in the back seat of the car at the time of the incident.

Several law enforcement sources reported that an ICE team was in the neighborhood searching for a man with a criminal record. A senior official indicated that the suspect had a prior arrest for robbery that resulted in a grand theft conviction and an open drug case.

The Department of Homeland Security and the FBI are on the scene, along with the New York Police Department (NYPD), which confirmed the shooting by “federal agents” in a post on X.

“The NYPD was not involved in the incident and was not at the scene at the time of the shooting. The injured person is at a nearby hospital, conscious and receiving medical treatment,” the NYPD stated.

The FBI’s Evidence Response Team in New York is en route to the scene to provide support to the Department of Homeland Security.

Governor Kathy Hochul stated that she had been briefed on the shooting and was awaiting a detailed report from federal authorities on the incident Thursday afternoon.

“We expect federal authorities to provide a full and transparent explanation of the circumstances surrounding this incident. New Yorkers deserve to know exactly what happened and why,” the governor wrote on X.

Statement from ICE

ICE released a statement regarding the incident.

“On October 8, at approximately 4:00 p.m. EST, ICE agents were conducting a targeted arrest operation in the Bronx, New York, to arrest an undocumented immigrant with a criminal record—originally from the Dominican Republic—who had a prior conviction for grand theft and multiple prior arrests for assault, robbery, drug possession, and weapons possession. The individual has ties to the Trinitarios gang, the same organization responsible for the brutal murder of a CBP officer last year,” the statement said.

“This undocumented immigrant with a criminal record had been arrested by the NYPD on December 7, 2023, but was released into the community a few days later due to reckless Democratic ‘sanctuary city’ policies, which endanger American lives,” they added.

“During the incident, an ICE agent discharged their weapon, and the individual was wounded.”

“ICE agents provided immediate assistance. The individual is alive and is being treated at a local hospital. The FBI and HSI are on the scene. The incident remains under investigation, and more information will be provided as it becomes available,” the statement said.

“When radical politicians who support ‘sanctuary’ policies release dangerous undocumented immigrants back onto the streets, our agents are forced to make arrests in the community, in unpredictable and risky environments. Our agents should not have to risk their lives, nor should innocent Americans face unnecessary danger, simply because such politicians refuse to cooperate with federal law enforcement,” the ICE statement concluded.
