Temperatures are dropping across the Hudson Valley, and while many residents are winterizing their homes, the New York Attorney General is reminding New Yorkers about their rights when it comes to heating their residence.
The reminder is especially timely as one of the area’s most prominent utility companies, Central Hudson, initiated the first phase of a 3-year rate increase less than two months ago. As the Attorney General shared, there are several state protections in place to help assure that no one is left in the cold.

“As temperatures drop, I urge New Yorkers to know their rights to heat and hot water services, and to reach out to my office if their rights are being violated”, New York State Attorney General Letitia James wrote on Facebook. The reminders included guidelines for when a utility company can – and cannot – interrupt service to households.

“Extra Effort” Clause for New York Utility Companies During Winter Months
The first provision requires utility companies to make an “extra effort” in contacting customers about outstanding bills and the possibility of loss of service. Companies are required to notify a resident at least 15 days before shutting off service, with the “last warning” only coming after an an earlier notice was given at least 35 days before… and that’s not all.
Winter Utility Protections for Vulnerable New Yorkers
There are also protections in place for vulnerable communities. Service during winter months cannot be terminated in households that have recently experienced a family death, are suffering from a “serious health issue” or disability, or have children living in the home. Furthermore, residents cannot have their utilities interrupted between Christmas day and New Year’s day.
