EAST FLATBUSH — POLICE OFFICERS WERE JUSTIFIED IN THE SHOOTING DEATH OF AN ARMED MAN involved in a dispute last year, NY Attorney General Letitia James determined.
James’ Office of Special Investigation on Wednesday, Jan. 7, released a report on the death of Christin Emile, who died on May 12, 2024, following an encounter with New York City Police Department officers in Brooklyn. The thorough investigation, involving review of footage from body-worn cameras and security cameras, interviews with involved officers and witnesses, review of ballistics evidence, and comprehensive legal analysis, determined that prosecutor would not be able to disprove beyond a reasonable doubt at trial that the officers’ actions were justified under New York law.
At the time, the officers encountered a group of men arguing on Church Avenue near East 53rd Street. Emile ignored orders to drop his gun, stumbled when trying to flee and shot the officers, who returned fire. Emile was pronounced dead at a nearby hospital.
New York’s justification law allows a police officer to use deadly physical force when the officer reasonably believes it necessary to defend against the use of another person’s deadly physical force.
