Nichols, an appointee of President Donald Trump, ruled construction on the Empire Wind project could go forward while he considers the merits of the government\u2019s order to suspend the project. He faulted the government for not responding to key points in Empire Wind\u2019s court filings, including the contention that the administration violated proper procedure.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Norwegian company Equinor owns Empire Wind. Spokesperson David Schoetz said they welcome the court&#8217;s decision and will continue to work in collaboration with authorities. It\u2019s the second developer to prevail in court against the administration this week.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \"><a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/trump-offshore-wind-energy-climate-c0ac1e447c93126327f1922327921aa0\" rel=\"nofollow noopener\" target=\"_blank\">The Trump administration froze five big offshore wind projects<\/a> on the East Coast days before Christmas, citing national security concerns. Trump has targeted offshore wind from his first days back in the White House, most recently calling wind farms \u201closers\u201d that lose money, destroy the landscape and kill birds.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \"><a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/trump-offshore-wind-energy-climate-lawsuits-6b10dc13839cef525731ec0b86bc998f\" rel=\"nofollow noopener\" target=\"_blank\">Developers and states sued<\/a> seeking to block the order. Large, ocean-based wind farms are the linchpin of plans to shift to renewable energy in East Coast states that have limited land for onshore wind turbines or solar arrays.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \"><a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/trump-offshore-wind-energy-climate-lawsuits-23b39c946dfe8b83fcd03c6a9c0f1e92\" rel=\"nofollow noopener\" target=\"_blank\">On Monday, a judge ruled that the Danish energy company Orsted<\/a> could resume its project to serve Rhode Island and Connecticut. Senior Judge Royce Lamberth said the government did not sufficiently explain the need for a complete stop to construction. That wind farm, called Revolution Wind, is nearly complete. It\u2019s expected to meet roughly 20% of the electricity needs in Rhode Island, the smallest state, and about 5% of Connecticut\u2019s electricity needs.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Orsted is also suing over the pause of its Sunrise Wind project for New York, with a hearing still to be set. Dominion Energy Virginia, which is developing <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/dominion-virginia-offshore-wind-trump-energy-interior-f5e4078b55cb1449a80de390153b3ae2\" rel=\"nofollow noopener\" target=\"_blank\">Coastal Virginia Offshore Wind<\/a>, plans to ask a judge Friday to block the administration\u2019s order so it can resume construction, too.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">The fifth paused project is Vineyard Wind, under construction in Massachusetts. Owners Avangrid and Copenhagen Infrastructure Partners have not indicated publicly whether they plan to join the rest of the developers in challenging the administration.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Robin Shaffer, president of Protect Our Coast New Jersey, said the administration was right to stop construction on national security grounds. He urged officials to immediately appeal the adverse rulings and seek to halt all work pending appellate review. Opponents of offshore wind projects are particularly vocal and well-organized in New Jersey.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Empire Wind is 60% complete and designed to power more than 500,000 homes. Equinor said the project was in jeopardy due to the limited availability of specialized vessels, as well as heavy financial losses.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \"><a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/trump-offshore-wind-energy-climate-lawsuits-370884367bf3c15556dee43495cf11d9\" rel=\"nofollow noopener\" target=\"_blank\">During a hearing Wednesday, Judge Nichols said<\/a> the government\u2019s main security concern seemed to be over operation of the wind turbines, not construction, although the government pushed back on that contention.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">In presenting the government\u2019s case, Associate Attorney General Stanley Woodward, Jr. was skeptical of the perfect storm of horrible events that Empire Wind said would derail their entire project if construction didn\u2019t resume. He disagreed with the contention that the government\u2019s main concern was over operation.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">\u201cI don\u2019t see how you can make this distinction,\u201d Woodward said. He likened it to a nuclear project being built that presented a national security risk.
