Bloomberg Law<\/a>.<\/p>\nThe trademark application \u201creflects a departure\u201d from the drag performer\u2019s agreement to use his name for activism, Patagonia alleged. <\/p>\n
Emails exchanged between Wiley and Patagonia from 2022 reveal that the company specifically asked he refrain from using their logos \u201cor any substantially similar designs,\u201d including Patagonia\u2019s familiar Belwe font.<\/p>\n
After learning of the launch of Wiley\u2019s e-commerce store, which included apparel and stickers for sale reading \u201cPattie Gonia Hiking Club\u201d and a sticker bearing his drag name using the brand\u2019s font and silhouetted mountain peak logo, the brand\u2019s lawyers reached out again last February, the lawsuit says.<\/p>\n
\u201cPatagonia remains supportive of your work but must insist that the Pattie Gonia persona not be commercialized and continue to adhere to the commitments made in 2022,\u201d the email reads.<\/p>\n

\u201cUnfortunately, these latest product sales force Patagonia\u2019s hand and so I\u2019m asking that you discontinue sales of t-shirts and stickers (or any product) using Pattie Gonia branding or designs substantially similar to Patagonia\u2019s logos.\u201d<\/p>\n
Wiley and his business partner responded a few days later, saying they \u201chave never and will never reference the brand Patagonia\u2019s logo or brand,\u201d insisting there was \u201cplenty of room\u201d for both Patagonia and Pattie Gonia to \u201cplay in this box.\u201d<\/p>\n

According to the lawsuit, the drag queen\u2019s team dismissively added that they \u201ctrust Patagonia will stay on their side and we will stay on ours.\u201d<\/p>\n
Patagonia lawyers followed up about a month later requesting a meeting to discuss \u201ca way forward\u201d between the sides but Wiley did not respond, and continued \u201cto use and display Patagonia\u2019s logos,\u201d according to the complaint.<\/p>\n
It was at that point the brand said it realized Wiley would continue to flout their 2022 agreement.<\/p>\n
\u201cWhile Patagonia seeks only nominal monetary damages, the harm Pattie Gonia has caused and will cause to the PATAGONIA brand is irreparable and cannot be remedied by money damages or other remedies short of an injunction,\u201d the complaint reads.<\/p>\n
