To receive daily news and insights, subscribe to our free daily <a href=\"https:\/\/www.hoteldive.com\/signup\/?utm_campaign=Yahoo-Licensed-Content&amp;utm_source=yahoo&amp;utm_medium=referral\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Hotel Dive newsletter;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Hotel Dive newsletter<\/a>. <\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">On Wednesday, <a href=\"https:\/\/www.hoteldive.com\/news\/new-york-city-mayoral-race-hotel-industry-imact\/804485\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:New York City\u2019s newly elected Mayor;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">New York City\u2019s newly elected Mayor<\/a> Zorhan Mamdani issued a final rule <a href=\"https:\/\/www.nyc.gov\/mayors-office\/news\/2026\/01\/mamdani-administration-bans-hotel-hidden-fees-and-unexpected-cre\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:banning hotels across the city and country from charging consumers hidden \u201cjunk fees,\u201d;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">banning hotels across the city and country from charging consumers hidden \u201cjunk fees,\u201d<\/a> or the added costs tacked on to room rates often labeled as \u201cdestination fees,\u201d \u201cresort fees\u201d or \u201chospitality service fees,\u201d according to release from the Office of the Mayor.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The New York City Department of Consumer and Worker Protection <a href=\"https:\/\/www.nyc.gov\/assets\/dca\/downloads\/pdf\/about\/DCWP-NOH-Rules-Relating-to-Limitations-on-Hotel-Fees.pdf\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:proposed the rule;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">proposed the rule<\/a> last year, modeling it after a <a href=\"https:\/\/www.hoteldive.com\/news\/ftc-junk-fees-rule-takes-effect-hotels\/747738\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Federal Trade Commission rule;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Federal Trade Commission rule<\/a> that took effect in May. That rule makes it a deceptive trade practice \u201cto offer, display or advertise a price for a hotel without clearly and conspicuously disclosing the total price of the stay, including all mandatory fees,\u201d according to the release.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">In banning hotel junk fees, Mamdani aims to \u201censure transparency for consumers and save millions of dollars overall,\u201d per the release. The mayor\u2019s move garnered support from a local hotel owners association and workers\u2019 union.<\/p>\n<p>Hurting \u2018honest small businesses\u2019<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">In addition to hotel junk fees, Mamdani also took aim at unexpected credit card holds or deposits issued by New York hotels, banning those as part of the final rule as well. The pricing practices \u201ccheat consumers and hurt honest small businesses,\u201d according to the Mayor\u2019s office.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The junk fee prohibitions of the final rule will go into effect in New York on Feb. 21, the mayor\u2019s office announced. The ruling will apply to any hotel advertising to NYC residents, regardless of where the hotel is based.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">DCWP Commissioner Sam Levine said in the release that the department will \u201cuse its full enforcement authority to ensure hotels comply with the laws and rules of our city and we will be vigilant to ensure consumers have transparency in their transactions and that workers\u2019 rights are respected.\u201d<\/p>\n<p>Hospitality industry reacts<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Vijay Dandapani, president and CEO of the Hotel Association of New York, which represents more than 300 hotels in the city, said in a statement that the \u201chotel industry <a href=\"http:\/\/readme.readmedia.com\/Hotel-Association-of-New-York-Reaffirms-Commitment-to-Preventing-Hidden-Fees-for-Customers\/21231557\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:strongly supports rules to prevent hidden fees;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">strongly supports rules to prevent hidden fees<\/a> and to protect our customers, and has been outspoken about this issue in the past. We will work with the Mamdani administration to ensure that these new rules achieve those goals while also ensuring that hotels which do obey the law and treat customers fairly are not unduly affected.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Rich Maroko, president of New York hospitality workers\u2019 union the Hotel and Gaming Trades Council, also <a href=\"https:\/\/www.nyc.gov\/mayors-office\/news\/2026\/01\/transcript--mayor-mamdani-administration-bans-hotel-hidden-fees-\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:applauded Mamdani\u2019s move;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">applauded Mamdani\u2019s move<\/a> during a Wednesday press conference.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Hospitality industry associations, including the American Hotel &amp; Lodging Association, the Asian American Hotel Owners Association and the Travel Technology Association, have <a href=\"https:\/\/www.hoteldive.com\/news\/us-senate-committee-approves-hotel-junk-fees-bill\/723037\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:previously applauded legislation;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">previously applauded legislation<\/a> prohibiting deceptive advertising of hotel room prices.<\/p>\n<p>Other hotel legislation in NYC<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">In addition to this new junk fees rule, hotels in New York are also required to comply with the Hotel Service Disruption Act, which requires that consumers be notified of changes to service during their stay, as well as the <a href=\"https:\/\/www.hoteldive.com\/news\/nyc-safe-hotels-act-takes-effect\/747000\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Safe Hotels Act;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Safe Hotels Act<\/a>, which requires hotel operators to obtain a license in order to operate in the city.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Hotel industry associations <a href=\"https:\/\/www.hoteldive.com\/news\/hospitality-industry-professionals-rally-against-nyc-licensing-bill\/726848\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:rallied against the Safe Hotels Act;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">rallied against the Safe Hotels Act<\/a> before its passage, with former AHLA Interim President and CEO Kevin Carey previously claiming <a href=\"https:\/\/www.hoteldive.com\/news\/manhattan-lodging-market-q2-revpar-growth-challenges-\/725478\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:it would have destructive effects;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">it would have destructive effects<\/a> on New York\u2019s hotels.<\/p>\n","protected":false},"excerpt":{"rendered":"This story was originally published on Hotel Dive.
