The man accused of dumping his boyfriend\u2019s decomposing body into the trash<\/a> outside their Brooklyn apartment building and head-butting a cop who later arrested him bizarrely claimed he was the officer\u2019s boss, according to prosecutors.<\/p>\n

\u201cWhat are you doing? I\u2019m the captain of the police!\u201d Christopher Moss yelled as he tussled with cops trying to arrest him, prosecutors said at his arraignment in Brooklyn Criminal Court late Monday.<\/p>\n

He also tried to grab a gun from the NYPD detective he head-butted, prosecutors say.<\/p>\n

Darrell Montgomery\u2019s remains were discovered about 9 a.m. Friday<\/a> outside the couple\u2019s building on E. 21st St. near Ditmas Ave. in Flatbush after residents complained of a foul odor<\/a>.<\/p>\n

Moss, 38, was nabbed two days later about a mile away after a tipster called cops to report the suspect\u2019s location.<\/p>\n

Prosecutors said that as an NYPD detective approached to place him into custody, Moss lunged towards the cops and grabbed the detective\u2019s gun. He then headbutted the officer \u201cabout the face multiple times\u201d until the detective fell to the ground, according to court papers.<\/p>\n

The cop suffered a split lip and scrapes to his hand.<\/p>\n

After his arrest, Moss told cops he had lived with Montgomery, 33, for about four years and that the two of them smoked methamphetamines \u201con a consistent basis,\u201d Brooklyn Assistant District Attorney Tziyonah Langsam said during the suspect\u2019s arraignment.<\/p>\n

Moss is facing assault charges for fighting with cops as well as a charge of concealment of a corpse.<\/p>\n

Sporting a scraggly beard, a grimy black Polo shirt and jeans, Moss said nothing as Judge Linda Wilson ordered him held on $20,000 bail. Concealment of a corpse is not a bail-eligible offense but the charge of assaulting an officer is.<\/p>\n

Moss\u2019 legal aid attorney Robert Heilbronn told Wilson his client didn\u2019t actually attack the cops who took him into custody.<\/p>\n

\u201cMy client was assaulted,\u201d Heilbronn claimed. \u201cIn this case, he did not assault the police.\u201d<\/p>\n

Arresting officers jumped out of a car and demanded Moss\u2019 ID. When Moss refused \u201che was immediately punched in his left eye, which you can see, your honor \u2014 he has a black eye,\u201d Heilbronn told the judge.<\/p>\n

Moss only wrestled with cops because the officers tackled him to the ground, Heilbronn claimed.<\/p>\n

Montgomery\u2019s body showed no obvious signs of trauma. It\u2019s believed he likely died from natural causes or a drug overdose.<\/p>\n

Moss told detectives he found Montgomery dead in their apartment.<\/p>\n

\u201cHis body was stiff,\u201d Langsam said in court, recounting what Moss told investigators. \u201c(He) didn\u2019t call the police. (Instead he) tried to place his body in the garbage.\u201d<\/p>\n

Surveillance video recovered by the building\u2019s superintendent and shared with cops shows Moss dragging the body out in a blue bin to the garbage area, prosecutors said.<\/p>\n

Wilson ordered Moss to undergo a psychological evaluation.<\/p>\n

Moss has never been arrested in New York state but he was twice convicted of burglary in Connecticut in the two years leading up to his move to Brooklyn, prosecutors said.<\/p>\n

The city Medical Examiner is conducting an autopsy to determine exactly how Montgomery died. No foul play is suspected.<\/p>\n

Montgomery\u2019s body appeared dismembered but was later determined to be complete but very decomposed. It was not immediately clear when Montgomery died.<\/p>\n

Neighbors told the Daily News that at about 6-foot-3, Moss towered over the slender 5-foot-4 Montgomery but the couple was always seen together in the building, with a 54-year-old tenant noting, \u201cWhere you saw the tall one, you saw the short one.\u201d<\/p>\n

One 75-year-old neighbor recalled seeing Moss outside the building on Thursday, a day before Montgomery\u2019s body was found. Moss was muttering to himself, the tenant recalled.<\/p>\n

\u201cHe was front of the building, talking to the sun,\u201d she said.<\/p>\n

Montgomery\u2019s family is reeling from his death.<\/p>\n

\u201cHe just basically put my brother in a fetal position and tied him up in a bag, in a bin, and threw him out and went on and didn\u2019t come back,\u201d Montgomery\u2019s sister Shakeema told The News Monday. \u201cYou just sit there and just throw them away, like they\u2019re garbage, like they\u2019re nothing. He was loved. My brother was loved.\u201d<\/p>\n

Shakeema said neither she nor her mother ever met Moss and hadn\u2019t spoken to her brother in over a month. She said cops told the family Moss ditched the body when he could no longer tolerate the smell.<\/p>\n
