{"id":121223,"date":"2026-02-03T13:18:06","date_gmt":"2026-02-03T13:18:06","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/121223\/"},"modified":"2026-02-03T13:18:06","modified_gmt":"2026-02-03T13:18:06","slug":"ny-citizens-others-sue-to-block-trump-administrations-visa-ban-targeting-75-nations","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/121223\/","title":{"rendered":"NY citizens, others sue to block Trump administration&#8217;s visa ban targeting 75 nations"},"content":{"rendered":"<p data-block-key=\"ppk1g\">United States citizens, among them New Yorkers with relatives who in some cases are \u201cstuck\u201d in countries including Ghana, Jamaica, Guatemala and Ethiopia, have asked a federal judge in Manhattan to halt the Trump administration\u2019s pause on processing visas for nationals from 75 countries, contending the policy is based on racial stereotypes and hostility toward nonwhite immigrants.<\/p>\n<p data-block-key=\"62fnv\">The <a href=\"https:\/\/www.nilc.org\/wp-content\/uploads\/2026\/02\/Complaint.pdf\" rel=\"noopener nofollow\" target=\"_blank\">lawsuit<\/a>, filed in U.S. District Court on Monday, seeks to block the administration\u2019s month-old ban on processing visas for people from the targeted countries, almost all of which have populations that are significantly nonwhite. The administration claims the action is warranted because citizens from the 75 nations are at high risk of becoming a \u201c<a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/News\/visas-news\/immigrant-visa-processing-updates-for-nationalities-at-high-risk-of-public-benefits-usage.html\" rel=\"noopener nofollow\" target=\"_blank\">public charge<\/a>,\u201d or otherwise reliant on public benefits.<\/p>\n<p data-block-key=\"5llit\">The visa suspension, which the plaintiffs contend places nearly half of all visa applications on hold, including some already approved, is based on an \u201cunsupported and demonstrably false claim\u201d that nationals from those countries rely on public assistance, according to the complaint. The lawsuit is the latest legal challenge of the administration&#8217;s crackdown on legal and illegal immigration, a hallmark of President Donald Trump\u2019s second term.<\/p>\n<p data-block-key=\"ej2v3\">The lawsuit calls the \u201cpublic charge\u201d concerns &#8220;baseless\u201d and a pretext for limiting the immigration of nonwhites. It cites the president\u2019s \u201cwell-documented history\u201d of disparaging immigrants from Latin American, Caribbean, African and predominantly Muslim nations, all of which are well represented among those on the visa-ban list.<\/p>\n<p data-block-key=\"bmap4\">\u201cPresident Trump has referred to such immigrants as coming from \u201cshithole countries,\u201d countries that are \u201cfilthy, dirty, disgusting,\u201d \u201ca disaster,\u201d and \u201chellholes,\u201d and stated that such immigrants are \u201ctrash\u201d and \u201cgarbage,\u201d are \u201cpoisoning the blood of our country,\u201d and are \u201cnon-compatible with Western Civilization,\u201d according to the complaint. At once, the president has expressed a preference for white immigrants from nations including Denmark, Norway and Sweden.<\/p>\n<p data-block-key=\"682q8\">&#8220;The 75-country visa ban is yet another unlawful and racist policy from the Trump administration that disproportionately harms Africans seeking to immigrate to the United States,&#8221; Diana Konate, deputy executive director of policy and advocacy at the group African Communities Together, said in a statement.<\/p>\n<p data-block-key=\"9qlsh\">The Department of State, named as a defendant, along with Secretary of State Marco Rubio, did not respond to a request for comment. The State Department announced the visa ban in a <a href=\"https:\/\/x.com\/StateDept\/status\/2011478657680757214\" rel=\"noopener nofollow\" target=\"_blank\">post<\/a> on social media Jan. 14, writing it would \u201cpause immigrant visa processing from 75 countries whose migrants take welfare from the American people at unacceptable rates.\u201d<\/p>\n<p data-block-key=\"ec2of\">It added: \u201cThe freeze will remain active until the U.S. can ensure that new immigrants will not extract wealth from the American people.\u201d<\/p>\n<p data-block-key=\"65ddi\">The legal challenge alleges violations of the Administrative Procedure Act, as well as equal protection and due process claims. It was filed by a host of groups including the National Immigration Law Center, the Legal Aid Society and the Center for Constitutional Rights. It was brought on behalf of the Catholic Legal Immigration Network Inc., African Communities Together and 11 individuals suing on behalf of immigrant family members.<\/p>\n<p data-block-key=\"9f7r0\">Among the plaintiffs is Agnes Kyeremaa, a U.S. citizen and New York City resident, who petitioned on behalf of her four adult sons and daughters and grandchildren, all nationals and residents of Ghana. All four of her children\u2019s visas were approved and the fees paid, when they received notices that their visas were refused because Ghana is among the 75 nations subject to the blanket ban.<\/p>\n<p data-block-key=\"7kp3s\">\u201cMs. Kyeremaa has never been institutionalized, or wholly dependent on government aid for her life in the United States,\u201d the complaint states. \u201cShe lives, works, shops and pays local, state and federal taxes in New York City, New York.\u201d<\/p>\n<p data-block-key=\"81i31\">Another individual plaintiff is Patricia Richardson, a U.S. citizen and Bronx resident, who petitioned on behalf of her sister, a national and resident of Jamaica. Her visa was also approved, only to be rescinded because Jamaica is on the banned-nations list. Richardson, according to the court papers, \u201chas never been institutionalized, or wholly dependent on government aid for her life in the United States.\u201d<\/p>\n<p data-block-key=\"a3s0e\">\u201cShe supports herself and her family financially,\u201d according to the complaint, adding that Richardson, too, \u201clives, works, shops and pays local, state and federal taxes in New York City.\u201d<\/p>\n<p data-block-key=\"2anjd\">Cesar Andred Aguirre, a U.S. citizen who lives in Shirley, Suffolk County, is another of the individual plaintiffs. A warehouse supervisor who earned about $104,000 in 2024, Aguirre is seeking to be reunited with his wife, a Guatemalan national who usually lives in Shirley.<\/p>\n<p data-block-key=\"drvae\">His wife, Dania Mariela Escobar Carranza, has been \u201cstuck\u201d in Guatemala, with the couple\u2019s youngest child, after traveling there for a consular interview, then being notified that Guatemala was included on the list of banned nations.<\/p>\n<p data-block-key=\"6hi4e\">The lawsuit asks a judge to declare the visa ban \u201cunauthorized\u201d under U.S. law and the Constitution, bar the government from enforcing it and to resume \u201ccase-by-case\u201d consideration of visa applications.
