{"id":125620,"date":"2026-02-06T21:32:29","date_gmt":"2026-02-06T21:32:29","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/125620\/"},"modified":"2026-02-06T21:32:29","modified_gmt":"2026-02-06T21:32:29","slug":"staten-island-man-claims-hot-coffee-left-him-seriously-injured-sues-mcdonalds","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/125620\/","title":{"rendered":"Staten Island man claims hot coffee left him seriously injured, sues McDonald\u2019s"},"content":{"rendered":"<p class=\"article__paragraph article__paragraph--left\" id=\"SBAGPSF6KVAPTNMLHK4R3RR4QI\">STATEN ISLAND, N.Y. \u2014 A Staten Island man is suing McDonald\u2019s, claiming he was \u201cseriously\u201d and \u201cpermanently\u201d injured by hot coffee.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"ANB7ZRA4HZHELGRYMNHHQMRGPQ\">The plaintiff, Andrew Scibelli, 63, says he continues to incur medical expenses since the March 12, 2023, incident, which occurred at the Grant City location at 2154 Hylan Blvd., the lawsuit alleges. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"4U6OKL4SVFHIZNT2NRGT7KWI5E\">The civil complaint was filed Wednesday in state Supreme Court, St. George, court records show. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"5G2KAY7BMJF6JJYM3HEZGEE4T4\">Scibelli \u2014 an Ocean Breeze resident who lives two miles from the restaurant \u2014 ordered the beverage at the drive-thru window, the complaint continued. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"664JYDZFSRCVFJ7NQNCOEVNASA\">According to Manhattan-based injury attorney Leigh Eskenasi, it was the restaurant\u2019s \u201cnegligence\u201d and \u201ccarelessness\u201d that caused the plaintiff to be \u201cincapacitated\u201d by his injuries.<\/p>\n<p><img fetchpriority=\"low\" loading=\"lazy\" decoding=\"async\" alt=\"Man suing local McDonald's\" class=\"article__image-content\" src=\"https:\/\/www.newsbeep.com\/us-ny\/wp-content\/uploads\/2026\/02\/DGC35FGKLVGWVPPC22X5H57XAU.jpg\"  \/>A lawsuit filed recently on Staten Island claims a customer at the McDonald&#8217;s in Grant City was &#8220;seriously&#8221; and &#8220;permanently&#8221; injured by a coffee that was served too hot. Second-, third-degree burns, attorney claims<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"NZDWOQNZCFAYDC2SJJSTASYM3Q\">It was about 9:30 a.m. on the date of the incident, when Scibelli ordered food and \u201cmultiple coffees,\u201d his attorney said Friday in an interview with the Advance\/SILive.com <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"5Q42VROYDFEVHCXULAYCNCQ6UY\">When a worker handed the tray of coffees over to him, \u201cnone of the lids were secured, and they all spilled,\u201d said Eskenasi. \u201cThey spilled all over his chest, abdomen and groin.\u201d <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"AYZV62FSUJFGXMRGQCLWQALMIE\">The plaintiff drove home, at which point his wife took him to Northwell Staten Island University Hospital in Ocean Breeze. He suffered second- and third-degree burns as a result of the incident, Eskenasi said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"BV2R3I4SZ5DN5AY4O76XAPJDK4\">The defendants listed in the complaint include McDonald\u2019s Corporation and Lisa\u2019s Food Enterprises. The latter is a Staten Island-based business that owns several McDonald\u2019s franchise restaurants in the tri-state area, according to its website. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"4UPK2XS5OFBQ3NKYCEG4AEBJW4\">Neither company responded Friday to a request for comment. <\/p>\n<p>Similar cases over the years<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"YVQFRPLEVJA4FETCW6QD2FQCIU\">Lawsuits filed over restaurants\u2019 coffee temperatures are not uncommon. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"M7YNZT2G4FAL3ALBLDAAUP375A\">There was a famous case in 1994 in which a 79-year-old woman incurred third-degree burns on her legs and genitals from spilt coffee.
