Kathy Hochul has signed the <a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2025\/S138\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2025\/S138\">Medical Aid in Dying Act <\/a>into law, allowing terminally ill New Yorkers medical aid under specific circumstances. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"F7VAJBSXSZGJPDMG24GH5P3KEA\">The legislation, S.138\/A.136, allows mentally competent adults over the age of 18 with medically confirmed terminal illnesses and fewer than six months to live to request the self-administered, life-ending medication.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"YFEVWAOLBZHWZKM6JCQIB6FO2A\">Although recently signed, the legislation won\u2019t take effect for another six months as the state Department of Health works to implement regulations and ensure health care facilities are prepared. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"J6SPUILGVRHQ7DTHBFUZNIJMUA\">\u201cOur state will always stand firm in safeguarding New Yorkers\u2019 freedoms and right to bodily autonomy, which includes the right for the terminally ill to peacefully and comfortably end their lives with dignity and compassion,\u201d said Hochul. \u201cNew Yorkers deserve the choice to endure less suffering, not by shortening their lives, but by shortening their deaths \u2014 I firmly believe we made the right decision.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"2KDRSC5GLFDTHIZBWP5FYFRY34\">Hochul said the decision was deeply personal, citing her mother\u2019s experience with ALS and years of discussions with lawmakers, health experts, advocates and families affected by terminal illness.<\/p>\n<p>Key safeguards<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"XU6I52XW5RBIDKK252SJMAFJGQ\">The bill includes several safeguards intended to ensure patients are not coerced and that participation remains voluntary for health care providers. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"J4UATUQAENF5TFZZGMTHCSVUCM\">Among the requirements is a mandatory five-day waiting period between when a prescription is written and filled, as well as a required mental health evaluation by a psychologist or psychiatrist.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"5Q6VJWLDT5ESFCJWTWC2C3RE5Y\">Patients must also make an oral request for medical aid in dying that is recorded by video or audio. The law prohibits anyone who may financially benefit from a patient\u2019s death from serving as a witness or interpreter and limits eligibility to New York residents.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"5CPXMSDX2NDYDEVOUBTF3V3LTM\">Additional provisions require that a patient\u2019s initial evaluation by a physician be conducted in person and allow religiously affiliated home hospice providers to opt out of offering medical aid in dying. Violations of the law will be considered professional misconduct under state Education Law.<\/p>\n<p>Reaction from lawmakers and advocates <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"XLJ62AQEPJFWLJRFMNWMGZAB3Y\">Assemblymember Amy Paulin, the bill\u2019s Assembly sponsor, said the law provides dignity and reassurance at the end of life.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"L7GKBAEERND6TG5C6QOIUA6G4I\">\u201cMost people will never choose medical aid in dying, but they want the reassurance of having it as a compassionate safeguard that offers comfort even if it is never used,\u201d stated Paulin.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"HDX2OQRNUNDLBK6WE6D4ZYOJJE\">Manhattan Borough President Brad Hoylman-Sigal, argued that the measure reflects years of advocacy and testimony from patients and families.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"GUO2BNK3Z5BQ3FUIOR3THJ5CPQ\">\u201cThis bill is not about ending life \u2014 it is about shortening death and easing suffering,\u201d he said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"GMSJKQIQDRAQXK6JLVU7KW5GII\">New York is the 14th jurisdiction in the United States to permit medical aid in dying, joining states such as Oregon, Washington, Montana, Vermont, California, Colorado, the District of Columbia, Hawaii, New Jersey, Delaware, Maine and New Mexico. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"U7DFGILAP5BCHKDXT6A2CMNTKE\">Illinois Gov. JB Pritzker signed the End-of-Life Options for Terminally Ill Patients Act earlier this month.<\/p>\n<p>A look back<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"KZ5TDTEY5JCNDDQX3CO6YPUD6Y\"><a href=\"https:\/\/www.silive.com\/news\/2025\/12\/ny-gov-hochul-will-sign-medical-aid-in-dying-act.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.silive.com\/news\/2025\/12\/ny-gov-hochul-will-sign-medical-aid-in-dying-act.html\">As previously reported by Advance\/SILive.com<\/a>, Hochul announced in December that she would sign the bill after reaching an agreement with the Legislature on additional safety guardrails. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"6WZEVJ5YF5DANFLZDJLHHTZYVE\">The state Senate approved the measure on June 9 by a 35-27 vote, following Assembly approval on April 23 by a 81-67 vote. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"PYXDH2HJMJDVLEWN5RBAG6F44Y\">The legislation was carried by Hoylman-Sigal in the Senate and Paulin in the Assembly, with Staten Island Sen. Jessica Scarcella-Spanton serving as a prime co-sponsor. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"5V7JD3GNIVBPZG3GECMPHGMN2Y\">All four Staten Island assemblymembers \u2014 Charles Fall, Michael Reilly, Michael Tannousis and Sam Pirozzolo \u2014 <a href=\"https:\/\/www.silive.com\/news\/2025\/05\/staten-island-assemblymembers-reject-medical-aid-in-dying-act.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.silive.com\/news\/2025\/05\/staten-island-assemblymembers-reject-medical-aid-in-dying-act.html\">voted against the legislation<\/a>, as did state Sen. Andrew Lanza.
