{"id":128071,"date":"2026-02-09T22:14:56","date_gmt":"2026-02-09T22:14:56","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/128071\/"},"modified":"2026-02-09T22:14:56","modified_gmt":"2026-02-09T22:14:56","slug":"court-sides-with-brooklyn-tenants-who-havent-had-heat-or-hot-water-for-2-years","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/128071\/","title":{"rendered":"Court sides with Brooklyn tenants who haven&#8217;t had heat or hot water for 2 years"},"content":{"rendered":"<p>After arriving home from the arctic cold outside, Karlyn Murphy boils water on her stove, soaking her feet in blissful warmth.<\/p>\n<p>For more than two years, her Brooklyn building has had sporadic heat and hot water \u2014 but the suffering has reached a new level of intensity <a href=\"https:\/\/nypost.com\/2026\/02\/08\/us-news\/nyc-is-colder-than-antarctica-as-worst-winter-chill-in-20-years-pummels-northeast\/\" rel=\"nofollow noopener\" target=\"_blank\">with the recent polar chill<\/a>.<\/p>\n<p>The water ranges from tepid to icy. \u201cThose of us who don\u2019t have a gym membership for showering, or a friend nearby, resort to boiling water,\u201d Murphy told The Post. One neighbor spends an hour each day heating water for bathing her two tots. Stefano Giovannini for NY Post<\/p>\n<p>Frustration and discomfort constitute business as usual for Murphy and her fellow tenants at 491 Keap St., atop Hotel Indigo in the heart of Williamsburg. But, finally, there may be some relief in sight.<\/p>\n<p>Residents have been in an ongoing court battle with their notorious landlord, Meyer Chetrit, <a href=\"https:\/\/manhattanda.org\/d-a-bragg-d-o-i-commissioner-strauber-announce-indictment-of-landlords-for-tenant-harassment-in-chelsea-apartment-2\/\" target=\"_blank\" rel=\"noopener nofollow\">who was indicted <\/a>last fall for harassing two elderly stabilized tenants in a Chelsea building he owns. The fancy Williamsburg building, opened in 2018 and where rents are in the thousands, is in foreclosure \u2014 owing at least $133 million to the mortgage lender, according to a different lawsuit. Con Ed has been threatening to turn off the utilities, which went unpaid by the landlord.<\/p>\n<p>But late last month, a New York Supreme Court judge ruled that a summer-appointed receiver \u2014 someone designated to oversee the building \u2014 had not made needed repairs, including for heat and hot water. The tenants can now proceed with their efforts to get a different administrator \u2014 called a 7A administrator \u2014 to manage the building, collect rents and make repairs.<\/p>\n<p>It is \u201cpainstakingly clear that repairs have been minimal to nonexistent since the receivership appointment on August 6, 2025,\u201d judge Genine Edwards wrote, and \u201cthe receiver failed to adequately justify the delay in rectifying the hazardous conditions.\u201d<\/p>\n<p>A temporary boiler sits outside of the building, but brings heat mainly to the hotel portion. Stefano Giovannini for NY Post<\/p>\n<p>For its part, the boiler can leak.<\/p>\n<p>The boiler\u2019s connection to the building, residents say, isn\u2019t perfect.<\/p>\n<p>The owner \u201csimply abandoned the rental tenants,\u201d according to court papers filed by Robin LoGuidice of Grimble &amp; LoGuidice, who is representing the tenants, adding that the landlord has ignored the judge\u2019s orders to provide heat and hot water.<\/p>\n<p>A temporary boiler sits outside, but it is channeling heat mostly to the hotel \u2014 which occupies the bottom half of the building \u2014 and not to the renters, LoGuidice said. Even so, the boiler is inadequate for the building\u2019s size. Hotel guests <a href=\"https:\/\/www.ihg.com\/hotelindigo\/hotels\/us\/en\/brooklyn\/nycmp\/hoteldetail\/hotel-reviews\" target=\"_blank\" rel=\"noopener nofollow\">have left multiple online reviews<\/a> complaining about the frigid water.<\/p>\n<p>\u201cThis hotel allowed us to check in without notifying us that all of the water was ice cold (temperatures were in the teens, so it was brutally cold) and that we would be unable to shower during our entire stay,\u201d wrote one recent one-star reviewer.<\/p>\n<p>\u201cNo hot water at this hotel you can\u2019t even shower,\u201d wrote another. \u201cComplained 2x to staff and it was never fixed. Don\u2019t stay here!\u201d<\/p>\n<p>Frigid water has been the focus of recent online reviews for the hotel.<\/p>\n<p>Similarly, tenants have recorded tepid temperatures of the water coming from their faucets.<\/p>\n<p>Last summer, now-retired judge Lawrence Knipel appointed a receiver, Jason Sackoor, and a management company, NYC Management, to oversee the building.<\/p>\n<p>But they have been dragging their feet while the tenants suffer in the unforgiving cold, LoGuidice told The Post.<\/p>\n<p>\u201cThe receiver waited until the storm of the century,\u201d she said. \u201cThe building has several young families with infants.\u201d<\/p>\n<p>Rents in the building \u2014 opened in 2018 and <a href=\"https:\/\/streeteasy.com\/building\/500-metropolitan-avenue\" target=\"_blank\" rel=\"noopener nofollow\">described on StreetEasy<\/a> as \u201can upscale and exciting new destination\u201d offering \u201can effortless and elegant lifestyle\u201d \u2014 range from the $3,000s to $6,400. The tenants have been paying rent into escrow.<\/p>\n<p>The HVAC units have never worked well, court papers say, with tenants sweltering in the summer heat and, now, freezing in the winter chill.<\/p>\n<p>Rents in the Williamsburg building reach up to $6,400 per month. Stefano Giovannini for NY Post<\/p>\n<p>\u201cThe building is in foreclosure proceedings,\u201d Sackoor wrote in a statement to The Post, and the current management has been \u201caddressing as expeditiously and effectively as possible many open issues that existed well before their appointments by the Court.\u201d<\/p>\n<p>The boiler was assessed, and \u201cthe boiler\u2019s output isn\u2019t sufficient for the building\u2019s heating and hot water needs,\u201d the statement added. The permanent boiler replacement must be \u201ccustom built because of the building\u2019s unique construction.\u201d<\/p>\n<p>Meanwhile, \u201ca temporary larger capacity boiler is on order since Jan 16 with five vendors . . . Even with multiple entities engaged in the search, delivery has taken longer than anticipated because of the high demand at this time of year.\u201d<\/p>\n<p>There was no need to wait until a cold snap, LoGuidice said. The bigger boiler was ordered only after she filed an emergency proceeding to ask the judge to force repairs, she told The Post.<\/p>\n<p>If the heat isn\u2019t restored, she requested that the judge allow the tenants \u2014 with priority for those with children \u2014 to be temporarily relocated to the hotel in the bottom half of the building. Space heaters won\u2019t do \u2014 the electrical system is inadequate to support them, she said. She has so far had no response.<\/p>\n<p>Murphy, who also must boil water for use in her bathroom, said she has e-mailed her building\u2019s manager about providing tenants with access to a hotel room in order to shower. Stefano Giovannini for NY Post<\/p>\n<p>Murphy, a tenant of three years, said she has likewise e-mailed the building manager \u2014 also with no response \u2014 about providing tenants with access to a hotel room. \u201cWe tenants would work out a shower system among ourselves,\u201d she told The Post. \u201cWe are willing to share one room just to bathe.\u201d<\/p>\n<p>Murphy has also been trapped in the balky elevator, and has been awakened by smoke alarms that shriek randomly, sometimes in the wee morning hours. \u201cThe alarm is going off so much that we are becoming desensitized to it,\u201d Murphy told The Post.<\/p>\n<p>The constant false alarms create a \u201cboy who cried wolf\u201d scenario, said another tenant \u2014 risky if a real fire were to break out.<\/p>\n<p>\u201cGiven that this building is new construction, the number of violations is unconscionable,\u201d LoGuidice wrote in court filings. The tenants suffer from \u201ca complete lack of services, including a lack of superintendent and porter, lack of heat and hot water, elevator outages, lack of security,\u201d along with rat infestations and trash pileup.\u201d<\/p>\n<p>As of last August, the violations have been corrected \u201cto the extent possible,\u201d according to an affidavit by a Chetrit employee. He acknowledges the \u201congoing project to fix the existing boiler\u201d but \u201cthe process is complicated because it requires certain parts.\u201d He also said that the temporary boiler is sufficient and provides adequate heat.<\/p>\n<p>Con Ed has even notified renters the landlord has not paid the bills.<\/p>\n<p>The city has remained stuck in a historic cold spell for weeks. Paul Martinka for NY Post<\/p>\n<p>\u201cThe respondents have not engaged in unlawful harassment,\u201d a lawyer for Chetrit wrote in court papers. He did not reply to The Post\u2019s request for comment, and a message left with The Chetrit Group was not returned.<\/p>\n<p>The receiver, Sackoor, declined to comment on the most recent development, but said in a statement to The Post that \u201cwe walked into a hornet\u2019s nest of issues,\u201d in a building filled with \u201cproblems that were the makings of the building\u2019s owner. We are doing everything we can on a daily basis to address these problems.\u201d<\/p>\n<p>Four years ago, one residential tenant instituted a class-action suit against the building, which has a 421-a tax abatement, for overcharging its tenants.<\/p>\n<p>The rents in question \u201chave been lawful\u201d and \u201cPlaintiffs were not overcharged,\u201d the building\u2019s lawyer wrote in reply.
