{"id":131695,"date":"2026-02-12T20:35:12","date_gmt":"2026-02-12T20:35:12","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/131695\/"},"modified":"2026-02-12T20:35:12","modified_gmt":"2026-02-12T20:35:12","slug":"new-u-s-attorney-for-north-country-named-then-fired","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/131695\/","title":{"rendered":"New U.S. attorney for north country named, then fired"},"content":{"rendered":"<p class=\"text | article-text\">SYRACUSE, New York (WWNY) &#8211; Who is in charge of the U.S. Attorney\u2019s office in Syracuse?<\/p>\n<p class=\"text | article-text\">As of Thursday morning, the most correct answer might be \u201cnot sure.\u201d<\/p>\n<p class=\"text | article-text\">President Trump appointed an ally with no prior experience as a prosecutor, John Sarcone III, to lead the office, which handles criminal and civil cases involving federal law for a large part of New York state, from Albany to Syracuse to Watertown to Plattsburgh.<\/p>\n<p class=\"text | article-text\">But because Sarcone\u2019s appointment was as \u2018acting U.S. Attorney\u2019 he was limited to 120 days in office, and the judges in the Northern District of New York declined to extend that.<\/p>\n<p class=\"text | article-text\">The Trump administration attempted to get around the law by naming Sarcone as \u201c1st Assistant U.S. Attorney,\u201d and then as \u201cspecial attorney.\u201d<\/p>\n<p class=\"text | article-text\">Then a judge ruled what the administration was trying runs afoul of existing law governing vacancies in U.S. Attorney offices, and which assigns judges the job of picking an acting U.S. Attorney when a vacancy occurs.<\/p>\n<p class=\"text | article-text\">That gets us to Wednesday, when Northern District judges picked a veteran lawyer, Donald Kinsella, with deep experience in prosecution, to lead the U.S. Attorney\u2019s Office.<\/p>\n<p class=\"text | article-text\">The White House promptly fired him.<\/p>\n<p class=\"text | article-text\"> \u201cYou are fired, Donald Kinsella,\u201d Todd Blanche, the deputy attorney general <a href=\"https:\/\/x.com\/TheJusticeDept\/status\/2021978801035448566?s=20\" target=\"_self\" rel=\"nofollow\" title=\"https:\/\/x.com\/TheJusticeDept\/status\/2021978801035448566?s=20\">wrote on X<\/a>.<\/p>\n<p class=\"text | article-text\">\u201cJudges don\u2019t pick U.S. Attorneys, @POTUS does. See Article II of our Constitution,\u201d he wrote.<\/p>\n<p class=\"text | article-text\">The New York Times <a href=\"https:\/\/www.nytimes.com\/2026\/02\/11\/nyregion\/donald-kinsella-ndny-sarcone-trump.html\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.nytimes.com\/2026\/02\/11\/nyregion\/donald-kinsella-ndny-sarcone-trump.html\">reached Kinsella Wednesday evening<\/a> and he \u201cdid not yet know whether the White House email carried the force of law. He said he would discuss the matter with the district judges in the morning and go from there.\u201d<\/p>\n<p class=\"text | article-text\">A press release from the Northern District U.S. Attorney\u2019s Office Thursday continued to list Sarcone as \u201cFirst Assistant United States Attorney.\u201d <\/p>\n<p class=\"text | article-text\">The selection of who runs a U.S. Attorney\u2019s office is important because each office has broad authority to decide what and who gets investigated for federal crimes.<\/p>\n<p class=\"text | article-text\">U.S. Senator Charles Schumer (D-NY) reacted to the firing.<\/p>\n<p class=\"text | article-text\">\u201cEveryone knows Trump only cares about one quality in a U.S. Attorney: complete political subservience. The people of upstate New York deserve a qualified, independent prosecutor, not another political loyalist,\u201d Schumer said in a statement.<\/p>\n<p class=\"text | article-text\">Sarcone is among a number of interim U.S. attorneys installed by the administration who judges have found to be unlawfully serving in their positions.<\/p>\n<p class=\"text | article-text\">U.S. law normally requires senate confirmation for U.S. attorneys and only allows people to serve in the position without that confirmation for limited time periods. Under Trump, however, the Justice Department has sought to leave unconfirmed prosecutors in their positions indefinitely, often through novel personnel maneuvers that courts have later ruled to be improper.<\/p>\n<p class=\"text | article-text\">In December, Alina Habba resigned as the top federal prosecutor for New Jersey after an appeals court said she had been serving in the post unlawfully.<\/p>\n<p class=\"text | article-text\">Lindsey Halligan,<a href=\"https:\/\/apnews.com\/article\/letitia-james-eastern-district-of-virginia-trump-8c84bd8603a4b932f9cb2e451ef057a3\" rel=\"nofollow noopener\" target=\"_blank\">who pursued indictments<\/a> against a <a href=\"https:\/\/apnews.com\/article\/halligan-comey-james-trump-ffcb0688ddf013161ec0b9b4c13681f4\" rel=\"nofollow noopener\" target=\"_blank\">pair of Trump\u2019s adversaries<\/a>, left her position as an acting U.S. attorney in Virginia after a <a href=\"https:\/\/apnews.com\/article\/comey-james-justice-department-5ec1a59d152bc1fd000ade15e20745b5\" rel=\"nofollow noopener\" target=\"_blank\">judge concluded<\/a> in November that her appointment was unlawful and that <a href=\"https:\/\/apnews.com\/article\/comey-james-justice-department-5ec1a59d152bc1fd000ade15e20745b5\" rel=\"nofollow noopener\" target=\"_blank\">indictments she <\/a>brought against New York Attorney General Letitia James and former FBI Director James Comey must be dismissed.<\/p>\n<p class=\"text | article-text\">CBS News has much more background on the story <a href=\"https:\/\/www.cbsnews.com\/news\/justice-department-fires-u-s-attorney-in-new-york-hours-after-judges-picked-him-for-the-job\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.cbsnews.com\/news\/justice-department-fires-u-s-attorney-in-new-york-hours-after-judges-picked-him-for-the-job\/\">here.<\/a><\/p>\n<p class=\"copyright |\">Copyright 2026 WWNY.
