Rep. Nicole Malliotakis (R-NY) officially asked the US Supreme Court<\/a> to step in and protect New York\u2019s lone Republican-held House seat from a \u201cbaseless\u201d legal attack seeking to redraw the district ahead of the midterm elections.<\/p>\n

In an emergency application filed Friday with Justice Sonia Sotomayor, lawyers for Malliotakis argued that a lower court\u2019s \u201cindefensible\u201d ruling to scrap the current 11th Congressional District map<\/a> was unconstitutional.<\/p>\n

\u201cThe trial court\u2019s order has thrown New York\u2019s elections into chaos on the eve of the 2026 Congressional Election,\u201d according to the application.\u00a0<\/p>\n

The filing pleads for an immediate stay before the midterm election season kicks off in less than two weeks.<\/p>\n

Attorneys warned the legal limbo was \u201ca recipe for unconstitutional chaos, with no map in place and uncertainty\u201d as the clock ticks toward February 24, when nominating petitions are scheduled to begin circulating.<\/p>\n

The long-shot appeal comes weeks after a Manhattan judge ruled the current map \u2014 which links Staten Island and Southern Brooklyn \u2014 as \u201cunconstitutional.\u201d<\/p>\n

Judge Jeffrey Pearlman, who was once a staffer for Democratic Gov. Kathy Hochul, ordered a new map that would increase the number of minority voters to prevent \u201cunlawful vote dilution,\u201d he wrote in his ruling. <\/p>\n

Malliotakis\u2019 legal team slammed the ruling as a radical departure from the status quo, noting in their application that the district \u201chas largely maintained the same boundaries since the 1980s,\u201d and has been repped by both Democrats and Republicans in the last decade.<\/p>\n

The leap to the nation\u2019s highest court comes at a procedurally odd moment for the case, as the original lawsuit is still weaving through the state appeals process.<\/p>\n

The New York Court of Appeals \u2014 the state\u2019s top court \u2014 recently washed its hands of the stay request, claiming it lacked jurisdiction and sent the case back to the lower Appellate Division.\u00a0<\/p>\n

An attorney for the Elias Law Group, one of the many Democrat-affiliated groups involved in the lawsuit, told The Hill<\/a> that the application to the US Supreme Court was a \u201cdesperate appeal,\u201d and \u201cpremature and improper.\u201d<\/p>\n

The emergency application tries to address those concerns by simultaneously hoping the state appellate courts will \u201cput an end to this unconstitutional mischief,\u201d and that the Supreme Court can intervene before Feb. 24 \u201cif the appellate courts do not.\u201d\u00a0\u00a0<\/p>\n
