COURTHOUSE,
\n Feb 13 \u2013A man from Mexico who
\n entered the US in 2024 through
\n the CBP One app was detained
\n by ICE in 26 Federal Plaza on
\n February 13.<\/p>\n

Later that day he
\n filed a habeas corpus petition
\n in the US District Court for
\n the Southern District of New
\n York, where Inner City Press
\n found it.\u00a0 <\/p>\n

\u00a0The
\n petition says that while he
\n was arrested by NYPD in
\n September 2025, the Queens
\n DA’s office pursuant to Brady
\n told his lawyer the
\n complainant had recanted: “she
\n recanted her statement and is
\n uncooperative to move forward
\n with the trial. We will move
\n to dismiss.”<\/p>\n

\u00a0 Judge
\n Andrew L. Carter, as Part 1
\n judge, stayed any removal
\n without approval of the court.<\/p>\n
