Republican nominee for lieutenant governor<\/a>, imposed a\u00a0287(g) agreement under\u00a0the\u00a0Warrant\u00a0Service\u00a0Officer model.\u00a0These agreements are formal partnerships between police agencies and Immigration and Customs Enforcement.\u00a0Morticelli said the agreement only applies within the county jail.<\/p>\n\u201cOur agreement does not extend beyond the walls of this building. It is 100%\u00a0a jail\u00a0program,\u201d he said.<\/p>\n
The department has had one individual\u00a0who\u00a0qualified under the program since it was put into place.<\/p>\n
\u201cHe had been arrested locally for a sexual assault crime of a violent nature, and upon his release from our facility, was effectively transferred over to the custody of ICE for enforcement of the immigration warrant,\u201d Morticelli said.<\/p>\n
There are three different models that are typically used under 287(g)\u00a0agreements,\u00a0including the warrant service\u00a0officers\u00a0model.\u00a0The\u00a0Jail Enforcement Model\u00a0allows local law enforcement to\u00a0identify\u00a0and process individuals in their custody without documentation. The\u00a0model defined by ICE as a\u00a0\u201cforce multiplier\u201d,\u00a0the\u00a0Task Force Model,\u00a0allows local law enforcement to enforce limited immigration authority while performing routine police duties.<\/p>\n
Other counties in New York with\u00a0warrant service officer models\u00a0include Broome, Nassau, Niagara,\u00a0Otsego\u00a0and Steuben counties. The counties with the Task Force Model are\u00a0Nassau, Niagara,\u00a0Steuben\u00a0and Cattaraugus. Three municipalities also have Task Force Models in\u00a0place,\u00a0which include Allegany Village police, Camden\u00a0police\u00a0and Wayland police departments, according to ICE\u2019s website.<\/p>\n
\u201cIf someone is not brought into\u00a0the jail,\u00a0there\u2019s\u00a0nothing Madison County deputies are going to be doing immigration enforcement-wise. No one on our road patrol is certified under the warrant service officer\u00a0model. It\u00a0is only jail deputies,\u201d Morticelli said.<\/p>\n
The scope of the 287(g) agreement for Madison County is intended to best serve the county\u2019s residents, Morticelli said.<\/p>\n
\u201cIt enforces,\u00a0basically,\u00a0what\u00a0our office is looking to enforce.\u00a0It\u2019s\u00a0getting rid of criminals\u00a0and by\u00a0getting rid of, I mean through the legal process, through federal immigration law,\u201d he said.\u00a0“It\u2019s\u00a0not targeting any hardworking farmers, hardworking individuals that are contributing to the betterment of the community.”<\/p>\n
During a press conference last\u00a0month, Hochul said she wanted to ban 287(g)\u00a0agreements;\u00a0however,\u00a0she said\u00a0her top priority\u00a0is\u00a0to protect New York\u00a0residents.<\/p>\n
\u201cWhen individuals enter this country illegally and commit crimes, I want them\u00a0to be arrested\u00a0and tried. If\u00a0they\u2019re\u00a0convicted, they must be imprisoned and deported.\u00a0That\u2019s\u00a0what we have been doing for decades here because I need to protect the immigrant community from criminals as well,\u201d Hochul said.<\/p>\n
The Department of Homeland Security said in a press release that the policy would make New Yorkers less safe.<\/p>\n
\u201cWhen politicians bar local law enforcement from working with DHS, our law enforcement officers have\u00a0to\u00a0have a more visible presence so that we can find and\u00a0apprehend the\u00a0criminals let out of jails back into communities,\u201d Assistant Secretary Tricia McLaughlin said in the press release.<\/p>\n
DHS said that there are currently 7,113 \u201caliens\u201d\u00a0with criminal charges\u00a0in the state and McLaughlin concluded her statement by calling on Hochul to turn them over to federal agencies.\u00a0Since Hochul became governor, the state has turned over 1,400 convicted criminals to immigration officials, she said during the\u00a0press conference.\u00a0However, Hochul said she does not support the use of jails for immigration purposes.<\/p>\n
\u201cJails should be used for what our\u00a0sheriffs\u00a0need them for, a place to hold people accused of a crime before they have their trial\u00a0or for\u00a0misdemeanors. But cutting off access to our jails for ICE agents will make it harder for them to\u00a0operate\u00a0these large-scale operations, which\u00a0they\u2019re\u00a0building up to try and do right now in the\u00a0state\u00a0of New York,\u201d Hochul said.<\/p>\n
Morticelli said that until they are told otherwise, they will continue to\u00a0operate\u00a0with\u00a0their\u00a0287(g) model.<\/p>\n
\u201cWe\u2019re going to continue business as usual under our agreement in the name of public safety,\u201d Morticelli said. \u201cI believe that our current warrant service model\u00a0is in the best interest of public safety, given that it does allow for safe transfer of individuals and limits removal operations out in the community.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"Gov.
