{"id":136126,"date":"2026-02-17T14:15:07","date_gmt":"2026-02-17T14:15:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/136126\/"},"modified":"2026-02-17T14:15:07","modified_gmt":"2026-02-17T14:15:07","slug":"ny-law-proposed-to-limit-public-access-to-police-disciplinary-records","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/136126\/","title":{"rendered":"NY law proposed to limit public access to police disciplinary records"},"content":{"rendered":"<p class=\"article__paragraph article__paragraph--left\" id=\"OA3EWTG73ZAZJFW7F33XXEBHSM\">Syracuse, N.Y. \u2014 Several New York state lawmakers, including from the Syracuse area, are backing a bill that would limit public access to certain kinds of law enforcement disciplinary records.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"OLZUV7FTF5B7JCWJKPPOP4BWAU\">The bill would unwind <a href=\"https:\/\/apnews.com\/article\/us-news-ap-top-news-laws-new-york-police-180a15ea069de36be58f9db6b97e1180\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/apnews.com\/article\/us-news-ap-top-news-laws-new-york-police-180a15ea069de36be58f9db6b97e1180\">one of the police reforms<\/a> enacted in New York after the 2020 murder of George Floyd in Minnesota that led to mass protests. Lawmakers that year repealed a decades-old law that kept police disciplinary records secret.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"BA4LY7VKJBFNRJG5I7U5GIVAM4\">Now, lawmakers are <a href=\"https:\/\/nyassembly.gov\/leg\/?default_fld=&amp;leg_video=&amp;bn=A02074&amp;term=2025&amp;Summary=Y&amp;Actions=Y\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/nyassembly.gov\/leg\/?default_fld=&amp;leg_video=&amp;bn=A02074&amp;term=2025&amp;Summary=Y&amp;Actions=Y\">proposing legislation<\/a> that would block public access to records related to \u201cunfounded,\u201d \u201cexonerated\u201d and pending complaints against law enforcement officers.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"G7MY2PCUMBA6TONTVZQ7I4PEFA\">Unfounded complaints are defined in the legislation as those that are \u201cdetermined to lack factual basis and are dismissed without disciplinary actions or criminal charges.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"YLQUDNU7TFGUBBPUZM2IVRQXLQ\">Exonerated complaints are defined as those where \u201cthe alleged conduct occurred but was determined to be lawful.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"RSSPVNLJNZEI5NRHKEUS6HB5UA\">Transparency advocates say it is important to release all allegations of wrongdoing because they say police departments have historically cleared many officers too easily. The bill would change the law so that many complaints against officers would never become public.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"GHWNRWWXFNANLKXNILOJZD5JF4\">In New York City, for example, the legislation would seal the vast majority of police disciplinary records from the past five years.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"WFIOWQML25CLRLR55YMEEQDORA\">An independent review board there <a href=\"https:\/\/www.nyc.gov\/site\/ccrb\/policy\/data-transparency-initiative-allegations.page\" target=\"_blank\" rel=\"nofollow noopener\">has found<\/a> more than two-thirds of misconduct allegations over that time period to be unfounded, without enough evidence to make a ruling or determined the officer acted lawfully.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"56V4K2TCWJFXFDXNPGRLGX4NKE\">Tom Speaker, the legislative director at <a href=\"https:\/\/reinventalbany.org\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/reinventalbany.org\/\">the watchdog group Reinvent Albany<\/a>, said it is wrong to limit public access to public records.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"6DX7KWRPJVB5VPND6SWNXAEMKE\">\u201cThe real problem is not false accusations against police officers,\u201d he said. \u201cIt\u2019s a lack of serious enforcement against abuse of power by police officers.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"A7WHTTANP5G4HLFLANBTY6BIV4\">Speaker said complaints, even if they are determined to be unfounded or an officer is exonerated, can help track a pattern of conduct.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"R3VKAHM5END7RCHUWNPAFIVI5I\">\u201cYou might have an officer with 10 claims against them and maybe seven are labeled unfounded. That\u2019s something that we think the public should want to know,\u201d he said. \u201cBecause maybe the internal police disciplinary process sees it as unfounded, but the public might have a different perspective.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"5DYJS3NY65C7LPU6LEFDBJBX3I\">Law enforcement personnel records in New York state had long been considered \u201cconfidential\u201d under <a href=\"https:\/\/www.law.buffalo.edu\/content\/dam\/law\/content\/cle\/210324-2-materials\/crl-50-a.pdf\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.law.buffalo.edu\/content\/dam\/law\/content\/cle\/210324-2-materials\/crl-50-a.pdf\">state Civil Rights Law section 50-a<\/a>. Officers needed to approve of their records being released.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"INQIJQIAANDUBPFH6BE3AWPYQQ\">The Legislature <a href=\"https:\/\/nyassembly.gov\/leg\/?default_fld=&amp;leg_video=&amp;bn=S08496&amp;term=2019&amp;Summary=Y&amp;Actions=Y\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/nyassembly.gov\/leg\/?default_fld=&amp;leg_video=&amp;bn=S08496&amp;term=2019&amp;Summary=Y&amp;Actions=Y\">voted<\/a> in 2020 to repeal section 50-a and make the records available through the state Freedom of Information Law.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"UWUESINNVVGIVFXSGLD3LMXK3I\">One of the legislators who voted then to allow public access to the records was Assemblymember Al Stirpe, D-Cicero. He is now a co-sponsor of the legislation to restrict access.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"BWB5GCLCH5ELBAV67EOMUWJFKA\">Stirpe said he thinks the legislature needs to be \u201ca little more careful\u201d and only allow records related to proven wrongdoing to be released. He said he has heard from \u201cday one\u201d from police unions on the issue.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"Y24MLWTPS5CD5E4745GFAGSP4Y\">\u201cI\u2019m for accountability. Everybody has to be accountable,\u201d he said. \u201cThe one thing is you don\u2019t have to go by hearsay. It has to be something that\u2019s proven, that there\u2019s some conclusion.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"52XGM4PEJREN3IHFCLZBQNVJ6I\">Stirpe also said he wasn\u2019t sure whether the public could distinguish whether information released from an officer\u2019s personnel record was proven.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"5ZQ634OOFNDAZOIO7SCVETGDMI\">\u201cI think it can easily cause a false impression,\u201d he said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"2EFRWGBOXVE2VAIWCPMNXWCC3A\">State Sen. Chris Ryan, D-Geddes, is also a co-sponsor of the legislation. His spokesperson, Brooke Schneider, said the bill fixes an \u201cunintended consequence\u201d of the 2020 reforms.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"E5JFBEFVW5AZNFOZWYQRBRGKNA\">\u201cSenator Ryan believes we must protect the public while also ensuring that law enforcement officers are not subjected to undue harm from accusations that were never substantiated,\u201d she said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"SRCUYXP5K5B5XNBW7AARAKFSQY\">The Assembly bill has been referred to that chamber\u2019s governmental operations committee.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"6OVTTBWSDNDFTHP636YKGIPVR4\">The committee chair \u2014 Assemblymember John McDonald III, D-Cohoes \u2014 said he supports the bill.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"CXF6GZT5WRA6NHDP2IJFKGRWMY\">\u201cAs a former mayor who oversaw a decent size police department, I understand the public\u2019s concerns but also that of law enforcement,\u201d he said. \u201cNo one wants to have an allegation without merit in their file.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"HKT44VM56JCGLPCSGXKVW7YVZA\">The Senate bill has been referred to that chamber\u2019s codes committee. A spokesperson for the committee chair \u2014 state Sen.
