{"id":148546,"date":"2026-02-28T18:53:06","date_gmt":"2026-02-28T18:53:06","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/148546\/"},"modified":"2026-02-28T18:53:06","modified_gmt":"2026-02-28T18:53:06","slug":"ices-alleged-ruse-in-columbia-student-arrest-may-have-violated-law-attorneys-say","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/148546\/","title":{"rendered":"ICE&#8217;s alleged &#8216;ruse&#8217; in Columbia student arrest may have violated law, attorneys say"},"content":{"rendered":"<p data-block-key=\"jgf2w\">Federal immigration officers may have violated the law when they allegedly used a ruse to gain entry into the apartment of Columbia student <a href=\"https:\/\/gothamist.com\/news\/columbia-student-detained-by-ice-after-agents-enter-school-building-university-says\" rel=\"noopener nofollow\" target=\"_blank\">Ellie Aghayeva<\/a> and arrest her early Thursday morning, according to civil liberties advocates and legal experts.<\/p>\n<p data-block-key=\"f69pd\">Columbia President Claire Shipman <a href=\"https:\/\/president.columbia.edu\/news\/message-acting-president-claire-shipman-0\" rel=\"noopener nofollow\" target=\"_blank\">said<\/a> the officers \u201cmisrepresented themselves\u201d in Aghayeva\u2019s arrest, gaining entry into her off-campus Columbia residential building and apartment by claiming they were \u201cpolice\u201d looking for a missing child. The officers were carrying photos of the allegedly missing child and did not provide \u201cany kind of warrant,\u201d Shipman said.<\/p>\n<p data-block-key=\"evekv\">Federal officers are generally permitted to employ \u201c<a href=\"https:\/\/www.immigrantdefenseproject.org\/ice-ruses\/\" rel=\"noopener nofollow\" target=\"_blank\">ruses<\/a>,\u201d as they\u2019re called in immigration enforcement <a href=\"https:\/\/s3.documentcloud.org\/documents\/3288754\/FugOps-Handbook-2010-Complete.pdf\" rel=\"noopener nofollow\" target=\"_blank\">training materials<\/a>. But civil liberties advocates and legal experts said they can breach Fourth Amendment protections against unreasonable searches and seizures when their ruses are used to coerce cooperation and gain access to private areas.<\/p>\n<p data-block-key=\"d0o60\">Amy Belsher, director of immigrants\u2019 rights litigation for the New York Civil Liberties Union, said if the officers gained entry to Aghayeva\u2019s building under the guise of an emergency like a missing child, it would likely be unconstitutional.<\/p>\n<p data-block-key=\"1cmmh\">\u201cI think that that would be a violation of the Fourth Amendment because that consent was coerced, essentially,\u201d she said.<\/p>\n<p data-block-key=\"l8pk\">\u201cIt sounds like ICE gained entry into the dorm by claiming to be looking for a missing child, something that&#8217;s very exigent, very time sensitive,\u201d Belsher added. \u201cAnd if that is what happened and permission to enter was given for that reason, that&#8217;s coerced permission. That&#8217;s not true voluntary permission.\u201d<\/p>\n<p data-block-key=\"fsje\">A Department of Homeland Security spokesperson said in a statement that the officers who arrested Aghayeva \u201cverbally identified themselves\u201d and \u201cvisibly wore badges around their necks.\u201d The agency did not provide any additional detail about how the officers represented themselves. The DHS spokesperson also did not address Shipman\u2019s assertion that the officers claimed to be searching for a missing child. The agency has not responded to requests for additional comment.<\/p>\n<p data-block-key=\"32spt\">Aghayeva was <a href=\"https:\/\/gothamist.com\/news\/columbia-student-detained-by-ice-after-agents-enter-school-building-university-says\" rel=\"noopener nofollow\" target=\"_blank\">released<\/a> several hours after she was arrested, following a plea from Mayor Zohran Mamdani in his unannounced Oval Office <a href=\"https:\/\/gothamist.com\/news\/mamdani-makes-unscheduled-trip-to-meet-trump-on-thursday\" rel=\"noopener nofollow\" target=\"_blank\">visit<\/a> with President Donald Trump. The arrest was followed by a midday protest, with about 200 students and faculty members marching outside Columbia\u2019s gates.<\/p>\n<p data-block-key=\"3o2tl\">The whirlwind of events prompted fresh scrutiny of federal immigration officers\u2019 enforcement tactics, at a time where the Trump administration\u2019s enforcement initiative has drawn a torrent of criticism from the <a href=\"https:\/\/www.reuters.com\/world\/most-americans-back-trumps-deportation-goals-not-his-tactics-reutersipsos-poll-2026-02-26\/\" rel=\"noopener nofollow\" target=\"_blank\">public<\/a> and in the <a href=\"https:\/\/www.nytimes.com\/2026\/02\/23\/us\/politics\/judges-contempt-immigration-trump.html\" rel=\"noopener nofollow\" target=\"_blank\">federal courts<\/a>.<\/p>\n<p data-block-key=\"8rgd8\">Aghayeva, who is from Azerbaijan, is studying neuroscience and political science in Columbia\u2019s School of General Studies, which caters to nontraditional students, who are usually older than typical undergraduates. She entered the U.S. around 2016 on a visa, according to a lawsuit filed on her behalf in federal court. A DHS spokesperson said her student visa was revoked that same year, \u201cfor failing to attend classes.\u201d<\/p>\n<p data-block-key=\"66dfa\">Aghayeva\u2019s lawyer declined to comment on her case.<\/p>\n<p>ICE&#8217;s ruse playbook<\/p>\n<p data-block-key=\"1728s\">Immigration authorities have employed ruses for years, including in New York City. In a 2019 case, ICE officers knocked on a woman\u2019s door and told her in Spanish that they wanted to speak with her about the Bible, according to the <a href=\"https:\/\/www.immigrantdefenseproject.org\/ice-ruses\/\" rel=\"noopener nofollow\" target=\"_blank\">Immigrant Defense Project<\/a>, which references the encounter in \u201cKnow Your Rights\u201d documents. The woman didn&#8217;t let the officers in, and when they turned to leave she saw \u201cICE\u201d emblazoned on the back of their jackets.<\/p>\n<p data-block-key=\"ak578\">In 2020, after ICE agents allegedly posing as NYPD officers <a href=\"https:\/\/www.nydailynews.com\/2020\/10\/10\/ice-agents-pose-as-nypd-to-arrest-long-time-new-yorker-after-6-am-manhattan-door-knock-say-outraged-city-officials\/\" rel=\"noopener nofollow\" target=\"_blank\">arrested<\/a> an Inwood resident, then-Mayor Bill de Blasio sent the agency a <a href=\"https:\/\/www.nyc.gov\/assets\/immigrants\/downloads\/pdf\/NYC-Mayor-Letter-to-ICE-Ruses-10-9-2020.pdf\" rel=\"noopener nofollow\" target=\"_blank\">letter<\/a> asking that officers stop stating or implying they were with the NYPD. In the letter, de Blasio said his office had received \u201cnumerous reports\u201d of such ruses, and that the practice jeopardized the NYPD\u2019s relationship with immigrant residents.<\/p>\n<p data-block-key=\"70dvj\">The use of ruses has been encouraged by ICE. The agency\u2019s <a href=\"https:\/\/s3.documentcloud.org\/documents\/3288754\/FugOps-Handbook-2010-Complete.pdf\" rel=\"noopener nofollow\" target=\"_blank\">fugitive operations handbook<\/a> states that ruses &#8220;result [in] improved safety for the offers and the public by reducing the opportunity for the target to flee.&#8221; But there are limitations on just how far immigration officers \u2013 or any police \u2013 can go, before bumping up against Fourth Amendment protections.<\/p>\n<p data-block-key=\"64a44\">A federal judge in Los Angeles last summer <a href=\"https:\/\/www.aclusocal.org\/press-releases\/settlement-prohibits-ice-officers-use-deceptive-tactics\/\" rel=\"noopener nofollow\" target=\"_blank\">barred<\/a> ICE officers from identifying as state or local police and misrepresenting their purpose, following a class action lawsuit filed in 2020. The $2.6 million <a href=\"https:\/\/www.aclusocal.org\/app\/uploads\/drupal\/sites\/default\/files\/field_documents\/kidd_v._noem_settlement_agreement.pdf\" rel=\"noopener nofollow\" target=\"_blank\">settlement<\/a>, while allowing ruses under certain circumstances, bars local ICE officers from claiming they are conducting a criminal investigation when they are not; falsely claiming they are looking for people they aren&#8217;t \u2014 including presenting photos of other individuals; or falsely claiming that &#8220;their purpose involves danger to the resident and\/or public safety.&#8221;<\/p>\n<p data-block-key=\"f5qkb\">Lenni Benson, an immigration law expert and professor at New York Law School, agreed that if ICE agents used deception to enter Aghayeva\u2019s building without a warrant, it would likely be unconstitutional.<\/p>\n<p data-block-key=\"7g164\">\u201cTo dupe someone into consent to enter a building when you don\u2019t have a warrant does seem to be a conspiracy to violate the Fourth Amendment,\u201d Benson said.<\/p>\n<p data-block-key=\"dif4v\">But while the actions may have been unconstitutional, Benson said it\u2019s hard to find legal recourse to hold immigration authorities accountable for potentially breaking the law. A court-ordered <a href=\"https:\/\/www.nj.com\/news\/2026\/02\/trump-doj-violated-50-court-orders-in-nj-immigration-cases-advocates-say-its-no-accident.html\" rel=\"noopener nofollow\" target=\"_blank\">review<\/a> of immigration cases in New Jersey revealed more than 50 orders by federal judges had been violated since early December by the federal government in connection with challenges by immigrants fighting their detention.<\/p>\n<p data-block-key=\"ee1r3\">\u201cIn immigration law, finding a remedy for constitutional violations is extremely difficult,\u201d Benson said. \u201cIs this wrong? Yes. Is this unconstitutional? Yes. Are there remedies? Unfortunately, the remedies are not as powerful as we would like to believe.\u201d<\/p>\n<p data-block-key=\"2tj8o\">In the hours after Aghayeva\u2019s arrest, Columbia officials <a href=\"https:\/\/communications.news.columbia.edu\/news\/important-additional-updates-columbia-university\" rel=\"noopener nofollow\" target=\"_blank\">announced<\/a> they ramped up security around residential buildings and sent reminders to staff about their protocols for dealing with law enforcement officers.<\/p>\n<p data-block-key=\"cpbmc\">In her statement Thursday evening, Shipman said the fault was with federal officers, saying \u201cmisrepresenting identity and other facts to gain access to a residential building is a breach of protocol.\u201d<\/p>\n<p data-block-key=\"13tg4\">Shipman alleged the federal officers maintained the same ruse inside the building, where she said security camera footage captured the officers with a picture of the alleged missing child.<\/p>\n<p data-block-key=\"dm6ig\">\u201cThey made their way to the apartment they were targeting with the same story,\u201d Shipman said. A DHS spokesperson said the building manager and Aghayeva\u2019s roommate allowed them into her apartment.<\/p>\n<p data-block-key=\"anj77\">Once inside the apartment, Shipman said, \u201cit became clear they (the officers) misrepresented themselves.\u201d When a campus public safety officer arrived, Shipman said, he repeatedly asked for a warrant, which was not provided, and asked for time to call \u201chis boss,\u201d but was refused.<\/p>\n<p data-block-key=\"cigaa\">\u201cThe agents took our student,\u201d Shipman said.<\/p>\n<p data-block-key=\"ctb5s\">Under longstanding court rulings, law enforcement officers are generally required to have a judicial warrant or an occupant\u2019s permission when entering private areas, such as a home or apartment. But the courts have permitted <a href=\"https:\/\/www.law.cornell.edu\/wex\/exigent_circumstances\" rel=\"noopener nofollow\" target=\"_blank\">warrantless<\/a> entries and searches when immediate action is necessary to prevent injury, the destruction of evidence or some other harm.<\/p>\n<p data-block-key=\"2u4uv\">Columbia\u2019s <a href=\"https:\/\/immigration.columbia.edu\/getting-support\" rel=\"noopener nofollow\" target=\"_blank\">policies<\/a> require all law enforcement agents have a judicial warrant or subpoena to enter private areas of the university, including housing, except for in \u201cexigent circumstances.\u201d If any law enforcement officers try to enter private spaces, university officials have instructed staff to \u201cnot interfere,\u201d ask officers for credentials and any legal documents and contact the university\u2019s public safety department to respond.<\/p>\n<p data-block-key=\"6474g\">While Shipman called the federal officers\u2019 conduct \u201ca breach of protocol,\u201d protesters on Thursday pointed the finger at the university.
