COURTHOUSE,
\n Feb 27 \u2013 Henry Boone was
\n indicted as a felon in
\n possession of a gun in the
\n U.S. District Court for the
\n Southern District of New York
\n on June 28, 2023. <\/p>\n

Then a
\n superseding indictment under
\n the Armed Career Criminal Act,
\n allege three prior
\n convictions. But do they all
\n qualify?\u00a0\u00a0 On August
\n 2 Boone was brought by US
\n Marshals before SDNY Judge J.
\n Paul Oetken. Inner City Press
\n was there, the only media in
\n the courtroom.\u00a0 <\/p>\n

\u00a0The
\n prosecutor said that only the
\n day before she’d gotten the
\n transcript of Boone’s 1996
\n plea allocution to attempted
\n assault in the first degree,
\n for a shooting in 1437 Webster
\n Avenue in The Bronx on August
\n 28, 1994. <\/p>\n

\u00a0 The
\n Federal Defender asked for
\n time to study and submitted a
\n brief on this new document. <\/p>\n

On August 9 the
\n US Attorney’s Office submitted
\n a smart phone photo of the
\n Grand Jury Report, complete
\n with the shadow of the phone
\n that took the shot. <\/p>\n

Jump cut to June
\n 20 when the US Attorney Office
\n opposed suppression, arguing
\n that the Terry stop was
\n reasonable. <\/p>\n

On December 1
\n Boone’s Federal Defender wrote
\n in seeking to modify or
\n exclude four video clips of
\n his post-arrest statement.<\/p>\n

Jump cut February
\n 27, 2026 when the US
\n Attorney’s Office wrote in
\n that there are “productive
\n plea discussions” and asking
\n to put in another update on
\n March 13.<\/p>\n
