{"id":153155,"date":"2026-03-05T00:33:08","date_gmt":"2026-03-05T00:33:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/153155\/"},"modified":"2026-03-05T00:33:08","modified_gmt":"2026-03-05T00:33:08","slug":"nycs-fight-with-feds-over-transit-projects-continues","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/153155\/","title":{"rendered":"NYC&#8217;s fight with feds over transit projects continues"},"content":{"rendered":"<p>New York scored another victory in its fight to keep <a href=\"https:\/\/ny1.com\/nyc\/all-boroughs\/traffic_and_transit\/2026\/03\/03\/congestion-pricing-upheld-by-federal-judge-over-trump-s-objections\" target=\"_blank\" rel=\"nofollow noopener\">congestion pricing<\/a> going.<\/p>\n<p>\u201cThe state of New York has prevailed, and all the attacks that have been unleashed by the Trump administration on congestion pricing,\u201d said Gov. Kathy Hochul in a video posted to X. \u201cWe won in court again.\u201d<\/p>\n<p>What You Need To Know<\/p>\n<p>A judge ruled that congestion pricing can continue in New York City, but the MTA may be gearing for another legal battle with the USDOT over funding for the Second Avenue Subway extension to 125th Street<br \/>\n<br \/>The federal government stopped paying reimbursements for its share of the Gateway Tunnel Porject, between New York and New Jersey, and the Second Avenue subway in October<br \/>\n<br \/>A lawyer for the MTA sent a letter threatening legal action of $60 million\u00a0\u00a0in reimbursements to the federal government over funding for the Second Avenue subway<\/p>\n<p>In a 149-page decision, U.S. District Judge Lewis Liman determined that the Department of Transportation could not legally end the <a href=\"https:\/\/ny1.com\/nyc\/all-boroughs\/traffic_and_transit\/2025\/12\/31\/data-shows-congestion-pricing-a-success-after-a-year\" target=\"_blank\" rel=\"nofollow noopener\">Value Pricing Pilot Program<\/a>, or VPPP, agreement just because the administration changes its mind.<\/p>\n<p>\u201cIt is really a decision that shows that congestion pricing is legal, that it follows the rules,\u201d said Lisa Daglian, the executive director of the Permanent Citizens Advisory Committee to the MTA. \u201cAnd the cameras are staying on.\u201d<\/p>\n<p>But not everyone agrees that the ruling is the end. The DOT, in a statement, said it\u2019s considering its options \u2014 including an appeal.\u00a0<\/p>\n<p>\u201cThe judge did say, on a limited basis, that the DOT still has a right to terminate just pursuant to a different provision,\u201d said Valerie Mason, of the group New Yorkers Against Congestion Pricing Tax, which had filed a lawsuit <a href=\"https:\/\/ny1.com\/nyc\/all-boroughs\/traffic_and_transit\/2026\/01\/06\/congestion-pricing-hits-1-year-amid-fare-increase\" target=\"_blank\" rel=\"nofollow noopener\">against the toll<\/a> and lost. \u201cSo, again, we\u2019re hopeful that the DOT will go forward with this.\u201d<\/p>\n<p>But it\u2019s not clear what provisions those are. There could be a new, separate lawsuit.<\/p>\n<p>\u201cWe\u2019re waiting to see where this came out, to see what we were going to do next,\u201d said Mason. \u201cSo we\u2019re still planning about that.\u201d<\/p>\n<p>Meanwhile, on Tuesday, one of two cases was in court trying to guarantee funding for <a href=\"https:\/\/ny1.com\/nyc\/all-boroughs\/news\/2026\/02\/18\/gateway-tunnel-funding-fully-restored--construction-to-resume--hochul-says\" target=\"_blank\" rel=\"nofollow noopener\">the Gateway Tunnel<\/a>, the new rail tunnel being built between New York and New Jersey. The federal government said the project was originally stopped because of changes to the rules around contracting based on sex and race.<\/p>\n<p>The Gateway Development Commission complied, and it took an emergency court order to get millions of dollars paid after work had to stop.\u00a0<\/p>\n<p>\u201cWhile the four major contracts that were suspended back in February have been restarted, the Gateway Development Commission has two more contracts that they were planning to let out that they are now holding on to because they need clarity on the legal issues,\u201d said Tom Wright, president and CEO of the Regional Plan Association. \u201cThey need to make sure that the next money is going to come.\u201d<\/p>\n<p>Wright said these battles are about more than infrastructure.<\/p>\n<p>\u201cThis is part of a broader federal attack on, on, on local aid of all kinds,\u201d said Wright.<\/p>\n<p>A decision could be weeks away on <a href=\"https:\/\/ny1.com\/nyc\/all-boroughs\/traffic_and_transit\/2026\/02\/06\/state-and-federal-lawyers-face-off-in-court-over-gateway-tunnel-funding\" target=\"_blank\" rel=\"nofollow noopener\">future Gateway funding<\/a>.<\/p>\n<p>\u201cThat delay can effectively kill a project because contracts expire, because costs go up dramatically over time, due to inflation or interest rates,\u201d said Wright.<\/p>\n<p>Now, the MTA is in the same position as the Gateway Development Commission.
