COURTHOUSE,
\n March 5 \u2013 A defendant charged
\n with shooting a man in The
\n Bronx with a gun he stored in
\n a bodega had a suppression
\n hearing on February 18 before
\n U.S. District Court for the
\n Southern District of New York
\n Judge Naomi Reice Buchwald.
\n Inner City Press was there,
\n the only media in the
\n courtroom.\u00a0\u00a0\u00a0 <\/p>\n

The SDNY
\n prosecutors put Officer Ramos
\n on the stand, to identify the
\n defendant in a video. <\/p>\n

He said he’d also
\n been shown a video by the
\n bodega owner, in his warehouse
\n nearby “in the confines of the
\n 41st Precinct,” once known as
\n Fort Apache. <\/p>\n

\u00a0 Defense
\n counsel argued that if the
\n officer had seen the video, he
\n would have had probable cause
\n to arrest the defendant
\n earlier. The judge seemed
\n skeptical.\u00a0 <\/p>\n

On November 3,
\n the US Attorney’s Office filed
\n opposition to the defense
\n motion to exclude expert
\n testimony on the relationship
\n between firearms and narcotics
\n trafficking.<\/p>\n

On November 17 he
\n pled guilty.<\/p>\n

On March 5, 2026
\n the US Attorney’s Office wrote
\n in asking for an upward
\n variance to 180 months on
\n March 12.<\/p>\n

\n 1:23-cr-439 (Buchwald)<\/p>\n
