{"id":168236,"date":"2026-03-19T15:13:10","date_gmt":"2026-03-19T15:13:10","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/168236\/"},"modified":"2026-03-19T15:13:10","modified_gmt":"2026-03-19T15:13:10","slug":"new-york-state-police-charge-two-people-with-leandras-law","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/168236\/","title":{"rendered":"New York State Police charge two people with Leandra\u2019s Law"},"content":{"rendered":"<p class=\"mb-4 text-lg md:leading-8 break-words\">(WIVT\/WBGH) \u2013 New York State Police made two separate arrests this week involving individuals who allegedly drove under the influence in the presence of children.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">On March 14, at around 4:39 a.m., New York State Police at Owego arrested Michael Holbert, 42, of Bainbridge.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">A Trooper was dispatched by the Tioga County 911 Center to State Route 17\/Interstate 86 near exit 63 for a report of a motor vehicle collision.\u00a0 Upon arrival, Troopers determined that a 2002 Volkswagen was traveling west and struck a guardrail, causing the vehicle to become disabled partially in the roadway.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Holbert told the Trooper that he and a 4-year-old passenger were not injured.\u00a0The Trooper says Holbert smelled of alcohol, and he was asked to perform Standardized Field Sobriety Tests, which confirmed impairment.\u00a0 His reportable B.A.C was .15%.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Holbert was charged with Aggravated Driving While Intoxicated with a Child Passenger Less Than 16 (Leandra\u2019s Law), a Class E Felony.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">On March 15, at around 8:34 p.m., New York State Police at Deposit arrested Trent Burgess, 34, of Churchville.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">A Trooper observed a 2016 BMW M4 on State Route 17 traveling west, committing a vehicle and traffic infraction. The Trooper initiated a traffic stop.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\"><a class=\"link \" href=\"https:\/\/www.binghamtonhomepage.com\/news\/crime\/candor-woman-arrested-under-leandras-law-after-crash\/?ipid=promo-link-block1\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Candor woman arrested under Leandra\u2019s Law after crash;elm:context_link;itc:0;sec:content-canvas\" data-yga=\"{&quot;yLinkElement&quot;:&quot;context_link&quot;,&quot;yModuleName&quot;:&quot;content-canvas&quot;,&quot;yLinkText&quot;:&quot;Candor woman arrested under Leandra\u2019s Law after crash&quot;}\"> Candor woman arrested under Leandra\u2019s Law after crash <\/a><\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">While interviewing Burgess, the Trooper says they smelled an odor of alcohol and observed characteristics associated with impairment.\u00a0 An 11-year-old child was also in the vehicle.\u00a0 Burgess was asked to perform Standardized Field Sobriety Tests, which confirmed impairment. His reportable B.A.C was .12%.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Burgess was charged with Aggravated Driving While Intoxicated with a Child Passenger Less Than 16 (Leandra\u2019s Law), a Class E Felony.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Leandra\u2019s Law, officially known as the Child Passenger Protection Act, was passed in 2009 in memory of 11-year-old Leandra Rosado, who lost her life in a drunk driving accident. The law is a New York state statute making it an automatic felony to drive drunk or impaired by drugs with a person aged 15 or younger in the vehicle. It carries penalties of up to four years in prison, mandatory ignition interlock devices for all convicted, and license suspension.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Copyright 2026 Nexstar Media, Inc.
