SDNY COURTHOUSE,
\n March 23 \u2013 For the murder of
\n Johnny Gaston on December 15,
\n 2022, Gibran Guerrero and
\n Yorvin Gomez were presented
\n and detained on August 21 in
\n U.S. District Court for the
\n Southern District of New York
\n Magistrates Court, which Inner
\n City Press closely covers. <\/p>\n

The prosecutors
\n says they “lured two victims
\n to a location in the Bronx and
\n robbed them.\u00a0 During the
\n robbery, one of the victims,
\n Johnny Gaston, was shot and
\n killed.\u00a0 The other victim
\n was shot but survived.”<\/p>\n

\u00a0The Augst 9
\n indictment unsealed on August
\n 21 charges murder in aid of
\n racketeering. It was wheeled
\n out to District Judge Lorna G.
\n Schofield.\u00a0 <\/p>\n

On October 21,
\n counsel to Guerrero wrote in
\n about “a change of plea
\n hearing in the near future.”
\n And Guerrero came to the SDNY
\n Magistrates Court on October
\n 29. But the plea did not go
\n forward. He may re-appear on
\n Firday, November 1…<\/p>\n

On November 1 he
\n decided to change lawyers, and
\n got the day’s CJA on duty.
\n Later the AUSA wrote in to
\n delay the trial.<\/p>\n

On November 6
\n Judge Schofield endorsed that
\n the parties by November 21
\n should file a joint letter
\n about moving the trial to
\n February 2025 or later April
\n 2025.<\/p>\n

On May 7, 2025
\n Guerrero pled guilty,
\n provisionally, in the
\n Magistrates Court, with
\n sentencing control date set
\n for August 7.<\/p>\n

On May 16
\n District Judge Schofield based
\n on the transcript accepted the
\n guilty plea.<\/p>\n

On March 23, 2026
\n Guerrero was sentenced to 27
\n years in prison.<\/p>\n
