{"id":174023,"date":"2026-03-25T00:38:14","date_gmt":"2026-03-25T00:38:14","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/174023\/"},"modified":"2026-03-25T00:38:14","modified_gmt":"2026-03-25T00:38:14","slug":"new-york-times-says-pentagon-is-defying-court-order-in-press-rules","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/174023\/","title":{"rendered":"New York Times Says Pentagon Is &#8220;Defying&#8221; Court Order In Press Rules"},"content":{"rendered":"<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tThe <a href=\"https:\/\/deadline.com\/tag\/new-york-times\/\" id=\"auto-tag_new-york-times\" data-tag=\"new-york-times\" rel=\"nofollow noopener\" target=\"_blank\">New York Times<\/a> is seeking a new order that compels Defense Secretary <a href=\"https:\/\/deadline.com\/tag\/pete-hegseth\/\" id=\"auto-tag_pete-hegseth\" data-tag=\"pete-hegseth\" rel=\"nofollow noopener\" target=\"_blank\">Pete Hegseth<\/a>\u2018s team to rescind a set of press access restrictions that a federal judge ruled unconstitutional last week.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tIn a filing Tuesday afternoon, the Times accused the <a href=\"https:\/\/deadline.com\/tag\/pentagon\/\" id=\"auto-tag_pentagon\" data-tag=\"pentagon\" rel=\"nofollow noopener\" target=\"_blank\">Pentagon<\/a> of \u201ccontemptuously defying\u201d <a href=\"https:\/\/deadline.com\/2026\/03\/judges-tosses-pentagon-press-restrictions-pete-hegseth-1236761929\/\" rel=\"nofollow noopener\" target=\"_blank\">U.S. District Judge Paul Friedman\u2019s ruling last week<\/a>, which found that new restrictions on access to the complex were vague and violated the First Amendment. Among other things, the policy threatened to revoke reporters\u2019 credentials if they solicited unauthorized information, whether classified or unclassified.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tOn Monday, Pentagon spokesman Sean Parnell unveiled a <a rel=\"nofollow noopener\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.287334\/gov.uscourts.dcd.287334.37.2.pdf\" target=\"_blank\">revised policy <\/a>that replaced the term \u201csolicitation\u201d with \u201cintentional inducement of unauthorized disclosure.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tBut the Times attorneys, including Ted Boutrous and Katie Townsend, <a rel=\"nofollow noopener\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.287334\/gov.uscourts.dcd.287334.37.0.pdf\" target=\"_blank\">wrote in their filing<\/a> that the revisions are actually new restrictions. They said that the new language would merely be a \u201c\u2018rebuttable presumption\u2019 that a reporter who offers a Department source \u2018anonymity or privacy protection\u2019 has committed a so-called \u2018intentional inducement of unauthorized disclosure.&#8217;\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tThe Times attorneys also claimed retaliation, pointing to Parnell\u2019s announcement that reporters will be prohibited from the Pentagon building without the escort. Parnell announced that <a href=\"https:\/\/deadline.com\/2026\/03\/pentagon-press-pete-hegseth-1236763617\/\" data-type=\"post\" data-id=\"1236763617\" rel=\"nofollow noopener\" target=\"_blank\">reporter workspaces would be moved to an outside annex<\/a>.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tThe Times attorneys wrote that \u201crather than comply with the court\u2019s order and accompanying opinion,\u201d the Pentagon team is \u201ccontemptuously defying it \u2014 both in letter and spirit in a newly released \u2018interim\u2019 policy.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tIn their filing, the Times\u2019 attorneys cited a quote that Timothy Parlatore, counsel for the Pentagon, gave to the Times reporting on the revisions. Parlatore said that the revisions \u201cuse more words to say the same thing.\u201d <\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tFriedman <a href=\"https:\/\/deadline.com\/2026\/03\/judges-tosses-pentagon-press-restrictions-pete-hegseth-1236761929\/\" rel=\"nofollow noopener\" target=\"_blank\">wrote in his opinion<\/a>, \u201cThe Court recognizes that national security must be protected, the security of our troops must be protected, and war plans must be protected. But especially in light of the country\u2019s recent incursion into Venezuela and its ongoing war with Iran, it is more important than ever that the public have access to information from a variety of perspectives about what its government is doing \u2014 so that the public can support government policies, if it wants to support them; protest, if it wants to protest; and decide based on full, complete, and open information who they are going to vote for in the next election.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tThe Pentagon plans to appeal the ruling. <\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto     \">\n\tThe new restrictions, put in place last year, led to an exodus of news outlets from the Pentagon, as reporters refused to sign an agreement as a condition to renew their credentials. Major broadcast and cable networks, as well as outlets from the AP to Newsmax, departed the complex.
