Derell Mickles is scheduled to stand trial on June 3, more than a year and a half after police shot him nine times at the Sutter Avenue station on Sept. 15, 2024.<\/p>\n
Prosecutors charged Mickles with eight counts, including attempted aggravated assault on a police officer, menacing a police officer and criminal possession of a weapon.<\/p>\n
Surveillance video and police body camera footage from that day show Mickles entering the station twice without paying and, at one point, holding a pocketknife. <\/p>\n
Authorities say Officers Edmund Mays and Alex Wong approached Mickles on the platform and repeatedly ordered him to drop the knife. When he did not comply, officers used a Taser before they opened fire, striking him nine times.<\/p>\n
Two bystanders were caught in the gunfire. One of them, Gregory Delpeche, was shot in the head.<\/p>\n
Delpeche\u2019s family has filed a lawsuit against the city seeking $80 million in damages. The suit alleges he suffered a traumatic brain injury that left him partially paralyzed and caused lasting cognitive and neurological damage.<\/p>\n
In a statement to News 12, the family\u2019s attorney said Delpeche \u201ccontinues to suffer severe and life-long injuries\u201d but is working toward recovery.<\/p>\n
An internal investigation into the shooting was conducted, but both officers remain on the force.<\/p>\n
