Luigi Mangione’s federal trial start date has been pushed back from September to October, this after his lawyers were back in court Wednesday for a hearing to discuss their request to delay his federal trial.<\/p>\n
The defense argued that it would put a strain on the defense, citing an “impossible position” having to prepare for both his federal and state trials at the same time. <\/p>\n
U.S. District Judge Margaret Garnett reasoned that her main concern was for Mangione to get a fair trial. Because of this she effectively moved up the schedule outlining jury selection will be Oct. 5 so as for there not to be a conflict with the state trial. Garnett said that the new federal trial start date would be either Oct. 26 or Nov. 2.<\/p>\n
“Whether we like it or not, we are somewhat at the mercy of events in the state case,” Garnett said, adding that “it is inevitable that for me to ensure mr\u00a0 is assured a fair trial.”<\/p>\n
Mangione entered court on Wednesday wearing a beige prison outfit and his legs shackled as he sat next to his defense team.<\/p>\n
This hearing comes mere weeks after Mangione’s legal team asked a judge last month<\/a> to postpone his federal trial<\/a> in the killing of UnitedHealthcare CEO Brian Thompson until early next year and said they will seek to have his state murder trial delayed until September.<\/p>\n In a letter to Garnett last month, Mangione’s lawyers said that the then current schedule \u2014 the state trial in June and the federal trial in September \u2014 would put him \u201cin the position of needing to prepare for two complicated and serious trials at the same time.\u201d<\/p>\n The federal trial, currently set to begin with jury selection in late summer, now conflicts with a June 8 state trial date for second-degree murder. They asked Garnett to delay the federal trial until January 2027 so that they can have an opportunity to ask the state trial judge, Gregory Carro, to reschedule the start of that case from June 8 to Sept. 8. Mangione has pleaded not guilty in both cases.<\/p>\n Carro previously raised the possibility of moving the state trial to September \u2014 but only if federal prosecutors appealed Garnett\u2019s decision barring them from seeking the death penalty. They declined to do so, leaving the June state trial and September federal trial dates intact.<\/p>\n Keeping the current schedule would violate Mangione’s constitutional rights, his lawyers argued.<\/p>\n \n\t\t\t\t\t\t\t\tFederal prosecutors can appeal the judge’s decision. Erica Byfield with the latest.\u00a0\u00a0\n\t\t\t\t\t\t\t<\/p>\n Among other concerns, they said, preparations for jury selection in the federal case would overlap with the state trial, limiting Mangione’s ability to review questionnaires filled out by hundreds of potential jurors \u2014 infringing on his right to participate in his own defense.<\/p>\n Back-to-back trials would also rob Mangione of his right to effective assistance of counsel, his lawyers said, because they would be forced to prepare for the federal trial while simultaneously defending him in court at the state trial.<\/p>\n \u201cThough fierce advocates for their clients, defense counsel cannot be in two places at once,\u201d wrote Mangione’s lawyers, Karen Friedman Agnifilo, Marc Agnifilo and Jacob Kaplan.<\/p>\n Federal prosecutors oppose the request, they said.<\/p>\n The U.S. attorney’s office in Manhattan, which is prosecuting the federal case, declined to comment. A message seeking comment was left for the Manhattan district attorney’s office, which is prosecuting the state case.<\/p>\n Mangione, 27, faces the possibility of life in prison if he’s convicted in either case. At a court hearing in February, he spoke out against the prospect of two trials, telling the judge: \u201cIt\u2019s the same trial twice. One plus one is two. Double jeopardy by any commonsense definition.\u201d<\/p>\n Thompson, 50, was killed on Dec. 4, 2024, as he walked to a midtown Manhattan hotel for UnitedHealth Group\u2019s annual investor conference. Surveillance video showed a masked gunman shooting him from behind. Police say the words \u201cdelay,\u201d \u201cdeny\u201d and \u201cdepose\u201d were written on the ammunition, mimicking a phrase used to describe how insurers avoid paying claims.<\/p>\n Mangione, a University of Pennsylvania graduate from a wealthy Maryland family, was arrested five days later after he was spotted eating at a McDonald\u2019s in Altoona, Pennsylvania, about 230 miles (370 kilometers) west of Manhattan.<\/p>\n His lawyers have argued that authorities prejudiced his case by turning his arrest into a \u201cMarvel movie\u201d spectacle, including by having armed officers parade him up a Manhattan pier after he was flown to New York and by publicly declaring their desire to seek the death penalty before he was indicted.<\/p>\n In January, Garnett dismissed a federal murder charge \u2014 murder through use of a firearm \u2014 that had enabled prosecutors to seek capital punishment, finding it legally flawed.
