{"id":182910,"date":"2026-04-02T00:09:08","date_gmt":"2026-04-02T00:09:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-ny\/182910\/"},"modified":"2026-04-02T00:09:08","modified_gmt":"2026-04-02T00:09:08","slug":"nyc-outdoor-dining-returns-in-2026-but-with-more-red-tape","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-ny\/182910\/","title":{"rendered":"NYC outdoor dining returns in 2026 \u2014 but with more red tape"},"content":{"rendered":"<p>Al fresco munching is back on the menu \u2014 but don\u2019t grab a street-side seat just yet.<\/p>\n<p>New York City\u2019s beloved roadway dining setups have returned for 2026, with about 500 curbside cafes already approved under the city\u2019s Dining Out NYC program, according to the Department of Transportation.<\/p>\n<p>That\u2019s a fraction of the scheme\u2019s pandemic-times peak \u2014 when as many as 12,500 restaurants took over sidewalks and streets \u2014 making the revival <a href=\"https:\/\/nypost.com\/2025\/02\/20\/us-news\/nyc-restaurateurs-frustrated-as-city-issues-only-40-outdoor-dining-permits-with-thousands-still-in-limbo-extorted-money-from-us\/\" target=\"_blank\" rel=\"noopener nofollow\">look more like a slow crawl than a full-blown feast.<\/a><\/p>\n<p>Unlike in the almost-anything-goes COVID era, today\u2019s outdoor dining <a href=\"https:\/\/nypost.com\/2025\/03\/30\/us-news\/new-yorkers-facing-dry-summer-as-outdoor-booze-applications-lag-absolute-murder\/\" target=\"_blank\" rel=\"noopener nofollow\">comes with rules, fees \u2014 and a whole lot of paperwork.<\/a><\/p>\n<p>Restaurants now have to apply, pay for street space and rebuild their setups every year, all while following strict design requirements. <\/p>\n<p>Roadway dining is also seasonal, running only from April through late November \u2014 a restriction the City Council added back in 2023.<\/p>\n<p>That\u2019s been a tough pill to swallow for many restaurateurs, who say the red tape and shorter timeline have driven some eateries to drop out entirely.<\/p>\n<p>The cumbersome approval process doesn\u2019t help: roadway cafes require sign-off from the Department of Transportation, local community boards and even the city comptroller\u2019s office \u2014 while sidewalk setups also need a thumbs-up from the local council member.<\/p>\n<p>Of the roughly 1,300 sidewalk cafes allowed to operate year-round, only about 700 have full approvals so far. <\/p>\n<p><img style=\"aspect-ratio:1.49926794;display:block\" loading=\"lazy\" decoding=\"async\" data-modal-image=\"38965632\" width=\"885\" height=\"590\" src=\"https:\/\/www.newsbeep.com\/us-ny\/wp-content\/uploads\/2026\/04\/2025-new-york-city-lower-116056079.jpg\" alt=\"People dining outdoors at a cafe on Orchard Street in New York City.\" class=\"wp-image-38965632\"  \/>Al fresco dining is returning as the weather gets warmer, but the streets come with strings attached. Michael Nagle<\/p>\n<p>The rest are stuck in bureaucratic limbo, operating under conditional permits while the city works through a backlog \u2014 one that previously ballooned to more than 3,600 applications.<\/p>\n<p>And for restaurants hoping to jump into roadway dining this season, the clock is ticking.<\/p>\n<p>\u201cUnfortunately, this season may be out of reach for many restaurants because of how long it takes\u2026 to actually start setting up,\u201d said Andrew Rigie, executive director of the NYC Hospitality Alliance, as per <a href=\"https:\/\/gothamist.com\/news\/roadway-outdoor-dining-is-back-in-nyc-for-2026-but-its-only-a-slice-of-what-it-once-was\" target=\"_blank\" rel=\"noopener nofollow\">Gothamist<\/a>. \u201cWe just need to move quickly because time is of the essence.\u201d<\/p>\n<p>Still, City Hall is signaling a potential reset.<\/p>\n<p>City Council Speaker Julie Menin <a href=\"https:\/\/nypost.com\/2026\/02\/04\/us-news\/year-round-outdoor-dining-plan-to-finally-return-nyc-council-speaker-vows\/\" target=\"_blank\" rel=\"noopener nofollow\">vowed earlier this year to revive<\/a> year-round, pandemic-style outdoor dining and slash the red tape that\u2019s bogging restaurants down.<\/p>\n<p>\u201cThis is a big one \u2014 we will finally fix the city\u2019s outdoor dining program to make it year-round and reduce the regulatory burdens for restaurants,\u201d Menin said in February, adding the changes would help small businesses \u201csurvive and adapt\u201d and prevent job losses.<\/p>\n<p>Mayor Zohran Mamdani is also on board with bringing back year-round outdoor dining \u2014 a move that could resurrect the 24\/7 shed scene that once took over pandemic-era streets.<\/p>\n<p>The push builds on a plan from Councilman Lincoln Restler to ditch seasonal limits, expand curbside setups and cut through the city\u2019s notoriously painful approval process.<\/p>\n<p><img style=\"aspect-ratio:1.50146628;display:block\" loading=\"lazy\" decoding=\"async\" data-modal-image=\"38965626\" width=\"886\" height=\"590\" src=\"https:\/\/www.newsbeep.com\/us-ny\/wp-content\/uploads\/2026\/04\/gdp-figures-july-30-photographer-124857933.jpg\" alt=\"Customers at outdoor seating at a restaurant in New York.\" class=\"wp-image-38965626\"  \/>City leaders, including Council Speaker Julie Menin and Mayor Zohran Mamdani, are pushing to bring back year-round outdoor dining and streamline permits, hoping to revive the 24\/7 shed scene. Bloomberg via Getty Images<\/p>\n<p>Not everyone\u2019s cheering for a full-blown comeback \u2014\u00a0at its height, roadway dining<a href=\"https:\/\/nypost.com\/2025\/04\/29\/lifestyle\/nyc-restaurants-diners-frustrated-by-al-fresco-dining-regulations\/\" target=\"_blank\" rel=\"noopener nofollow\"> sparked plenty of gripes<\/a> \u2014 from trash and rats to noise and eyesore sheds crowding city streets.<\/p>\n<p>But despite detractors, the appetite for dining outdoors remains.<\/p>\n<p>Last fall, the city even <a href=\"https:\/\/nypost.com\/2025\/08\/31\/us-news\/nyc-launches-first-ever-outdoor-dining-week-here-are-the-deals-on-the-menu\/\" target=\"_blank\" rel=\"noopener nofollow\">launched its first-ever \u201cCurbside Dining Week<\/a>,\u201d in September, with eateries offering discounts and specials to entice diners into the streets.<\/p>\n","protected":false},"excerpt":{"rendered":"Al fresco munching is back on the menu \u2014 but don\u2019t grab a street-side seat just yet.
