The very idea that they can make the right decision is a charade.<\/p>\n<p>The board can do only one thing: set an annual rent increase for the city\u2019s nearly 1 million rent-stabilized units.<\/p>\n<p>These apartments might be in bankrupt, crumbling buildings in the South Bronx or in valuable, immaculate buildings on Park Avenue. Their tenants could be <a href=\"https:\/\/therealdeal.com\/new-york\/2026\/03\/11\/what-if-tax-the-rich-applied-to-rent-stabilized-tenants\/\" rel=\"nofollow noopener\" target=\"_blank\">1-percenters<\/a> with weekend homes or unemployed single moms with three kids.<\/p>\n<p>Every one gets the same rent increase, which this year will be zero if Mayor Zohran Mamdani gets his way.<\/p>\n<p>Imagine a gas station attendant tasked with fueling a million different vehicles \u2014 Ferraris and Priuses, Formula 1 cars and junkers, model planes and Airbus A380s, lawnmowers and yachts. All he has is 87-octane unleaded, and every machine must get the same amount.<\/p>\n<p>That\u2019s our Rent Guidelines Board.<\/p>\n<p>Everyone is focused on whether Mamdani will get his rent freeze, but the real story is how profoundly stupid this part of New York\u2019s rent stabilization system is.<\/p>\n<p>Regardless of how much data the rent board collects and how many hearings it holds, it cannot choose an appropriate rent increase. The world\u2019s most talented mechanic couldn\u2019t maintain a broken tricycle and the Space Shuttle with one turn of a wrench.<\/p>\n<p>Last week the board released data showing the financial performance of buildings with at least one rent-stabilized unit. Tenant activists and the mayor will focus on their <a href=\"https:\/\/therealdeal.com\/new-york\/2026\/03\/26\/rent-stabilized-buildings-saw-income-rise-in-2024-says-rgb\/\" rel=\"nofollow noopener\" target=\"_blank\">6.2 percent increase<\/a> in 2024 net operating income.<\/p>\n<p>Systemwide NOI is irrelevant, for two reasons.<\/p>\n<p>Imagine I argued that New Yorkers can afford high rents because their average household income last year was <a href=\"https:\/\/www.incomebyzipcode.com\/newyork\" rel=\"nofollow noopener\" target=\"_blank\">$128,247<\/a>. Tenant activists would say that\u2019s inflated by the <a href=\"https:\/\/www.nytimes.com\/2025\/08\/28\/nyregion\/nyc-millionaires.html\" rel=\"nofollow noopener\" target=\"_blank\">70,000<\/a> who make <a href=\"https:\/\/cbcny.org\/research\/hidden-cost-new-yorks-shrinking-millionaire-share\" rel=\"nofollow noopener\" target=\"_blank\">$1 million or more<\/a>, and they\u2019d be right.<\/p>\n<p>Yet these same activists pretend the 6.2 percent increase \u2014 an average that\u2019s inflated by core-Manhattan buildings with lucrative, market-rate units \u2014 is representative of all rent-stabilized landlords.<\/p>\n<p>They omit that <a href=\"https:\/\/www.thecity.nyc\/2026\/03\/26\/rent-freeze-board-mamdani-landlord-income\/#:~:text=The%20share%20of%20properties%20with%20negative%20net%20operating%20incomes%20fell%20slightly%20between%202023%20and%202024%2C%20from%209.3%25%20to%209.2%25%20citywide\" rel=\"nofollow noopener\" target=\"_blank\">more than 1 in 9 buildings<\/a> had a negative net operating income in 2024, meaning they <a href=\"https:\/\/therealdeal.com\/new-york\/2026\/02\/07\/rent-stabilized-bankruptcy-comes-to-middle-class-brooklyn\/\" rel=\"nofollow noopener\" target=\"_blank\">lose money every month<\/a>. And it\u2019s really much worse than 1 in 9.<\/p>\n<p>It\u2019s worse because of the second problem with NOI: It doesn\u2019t account for mortgage payments or six-figure expenditures like new facades, roofs, boilers and elevators. Yet the activists still portray NOI as \u201cprofit\u201d and never mention that 6.2 percent adjusted for inflation was just 2.2 percent.<\/p>\n<p>Politicians mimic this deception. Consider this statement last year by <a href=\"https:\/\/therealdeal.com\/new-york\/2025\/06\/30\/nyc-rent-guidelines-board-approves-3-increase\/\" rel=\"nofollow noopener\" target=\"_blank\">Brad Lander<\/a>, who was city comptroller at the time:<\/p>\n<p>\u201cTo stick all New Yorkers with a big rent increase because there are a small percentage of buildings that need a program to address distress, it\u2019s just a trick.\u201d<\/p>\n<p>But Mamdani would stick all rent-stabilized landlords with a rent freeze because of a small percentage of tenants who need a program to address distress \u2014 and already have many of them.<\/p>\n<p>Dozens of programs help tenants pay for <a href=\"https:\/\/www.fns.usda.gov\/snap\/supplemental-nutrition-assistance-program\" rel=\"nofollow noopener\" target=\"_blank\">groceries<\/a>, <a href=\"https:\/\/www.nyc.gov\/site\/hra\/help\/cityfheps.page\" rel=\"nofollow noopener\" target=\"_blank\">rent<\/a>, <a href=\"https:\/\/www.fcc.gov\/general\/universal-service-fund\" rel=\"nofollow noopener\" target=\"_blank\">electricity<\/a>, <a href=\"https:\/\/www.health.ny.gov\/health_care\/medicaid\/\" rel=\"nofollow noopener\" target=\"_blank\">health care<\/a>, <a href=\"https:\/\/www.childcare.gov\/state-resources\/new-york\/financial-assistance-resources-for-families\" rel=\"nofollow noopener\" target=\"_blank\">child care<\/a>, <a href=\"https:\/\/www.fcc.gov\/general\/lifeline-program-low-income-consumers\" rel=\"nofollow noopener\" target=\"_blank\">cell service<\/a>, <a href=\"https:\/\/access.nyc.gov\/programs\/affordable-broadband-act\/\" rel=\"nofollow noopener\" target=\"_blank\">internet<\/a> and even <a href=\"https:\/\/www.ny.gov\/services\/apply-heating-assistance-heap\" rel=\"nofollow noopener\" target=\"_blank\">heat<\/a> (although landlords pay that bill). Other programs provide a <a href=\"https:\/\/otda.ny.gov\/policy\/tanf\/\" rel=\"nofollow noopener\" target=\"_blank\">monthly benefit<\/a> or a <a href=\"https:\/\/www.irs.gov\/credits-deductions\/individuals\/earned-income-tax-credit-eitc\" rel=\"nofollow noopener\" target=\"_blank\">tax credit<\/a> that can be spent on anything.<\/p>\n<p>These safety-net programs sustain families, benefit the economy and backstop the risk-taking that is essential to capitalism. There is <a href=\"https:\/\/therealdeal.com\/new-york\/2025\/08\/29\/landlord-applies-in-vain-for-hardship-program-approval\/\" rel=\"nofollow noopener\" target=\"_blank\">no safety net<\/a> for <a href=\"https:\/\/therealdeal.com\/new-york\/2025\/05\/13\/nys-hardship-program-for-landlords-drives-applicants-mad\/\" rel=\"nofollow noopener\" target=\"_blank\">buildings<\/a> crippled by the 2019 Housing Stability and Tenant Protection Act, 10 years of <a href=\"https:\/\/therealdeal.com\/new-york\/2025\/06\/12\/rents-have-been-falling-for-10-years\/\" rel=\"nofollow noopener\" target=\"_blank\">below-inflation rent adjustments<\/a>, skyrocketing <a href=\"https:\/\/therealdeal.com\/magazine\/national-november-2023\/bronx-landlords-insurance-surges\/\" rel=\"nofollow noopener\" target=\"_blank\">insurance premiums<\/a> and an epidemic of <a href=\"https:\/\/therealdeal.com\/magazine\/january-2026\/cant-pay-wont-pay\/\" rel=\"nofollow noopener\" target=\"_blank\">nonpaying tenants<\/a>.<\/p>\n<p>Every spring, the Rent Guidelines Board charade consumes an incredible amount of attention.
