The OCM adopted the proposed rules, making it legal to grow cannabis at home across the state.

Rules and regulations of home cultivation in New York

With the legalization of home growing in 2024, the OCM outlined regulations that are important to know if you wish to grow your own cannabis.

Adults over the age of 21 are able to cultivate cannabis at home, according to the OCM. If you are under the age of 21 and you use cannabis for medical reasons, a parent or guardian can be assigned as a designated caregiver to grow on your behalf.

If you plan to grow, there are specific rules about the number of plants you can cultivate. One person can grow up to three mature plants and three immature plants at a time, but no residence can have more than six mature and six immature plants.

Once you’ve grown your plants, you can keep up to five pounds of trimmed cannabis and the equivalent weightin concentrates in or on the grounds of your residence, according to the OCM. If you plan to take your cannabis elsewhere, transport is limited to up to three ounces of cannabis and 24 grams of concentrates within the state.

It is illegal to sell, trade or barter the cannabis you grow.

Where can cannabis be grown?

If you plan to grow, you are required to ensure that the plant is in a secure location that is not accessible to anyone under the age of 21.

Cannabis can be grown in residences that you own or rent, like a room, home, apartment, mobile home, co-op or other residential spaces. Before you start, however, be sure to check with your landlord as they reserve the right to refuse to lease space to or penalize a tenant if they risk losing federal benefits, according to the OCM.

How to start growing

Cannabis seeds and immature plants will be available once licensed nurseries are operational. Press Secretary for the OCM Taylor Randi Lee said in March that the board, in consultation with the OCM, will be establishing the application process for nursery licenses in “the near future.”

More: <a href="https://www.pressconnects.com/story/news/public-safety/2026/01/15/broome-county-sheriffs-office-to-crack-down-on-illegal-cannabis-sales/88162061007/" rel="nofollow noopener" target="_blank" data-ylk="slk:Broome County has a new cannabis enforcement law. Critic says it evokes ‘war on drugs’

Rules and safety tips for growing

The OCM has outlined rules and safety tips to ensure the safe cultivation of cannabis plants.

If you’re planning to make cannabis products like tinctures or butters at home, the use of flammable materials is prohibited because they are not considered safe for home use, according to the OCM. To avoid a possible fire, consider alternative extraction methods such as heat, water or fermentation.

When growing cannabis at home, the plants will produce an odor whether they are planted indoors or outdoors. You are required to take “reasonable measures” like co-planting items like lavender in an outdoor garden or using a carbon filter for indoor cultivation to avoid being a nuisance to neighboring residents, according to the OCM.

It is also advised that you take precautionary measures to reduce the public’s view, like installing fences or other tall and bushy plants. This can prevent theft or unwanted access.

To grow more safely, the OCM recommends that you consider using LED lights and consulting an electrician about your cultivation setup. Keep the growing area clean, uncrowded and well ventilated. Growing cannabis plants indoors requires a significant amount of energy and can overload electrical circuits and cause fires.

Cannabis can become moldy if there is an excess of moisture. You can prevent this by controlling mold and fungus sources and using a dehumidifier, humidity monitor and fans to ensure proper ventilation. It is not safe to consume moldy cannabis.

This article originally appeared on Binghamton Press & Sun-Bulletin: <a href="https://www.pressconnects.com/story/news/public-safety/2026/04/06/is-it-legal-to-grow-your-own-cannabis-in-new-york-what-the-law-allows/89099013007/" rel="nofollow noopener" target="_blank" data-ylk="slk:Is it legal to grow your own cannabis in New York?
